staff" is substituted for the ambiguous reference, in
the fourth sentence of former Art. 40, § 59(d)(1),
"[w]hen promoted, an employee". This substitution
limits subsection (f)(2) of this section to promotions
of professional staff and, thus, conforms to the rest
of former Art. 40, § 59(d)(1).

In subsection (g)(1) of this section, the word "for"
is substituted for the former phrases "upon proof of",
since, under subsection (g)(2)(ii) of this section,
only an opportunity for a hearing is required.

In subsection (g)(2)(i) of this section, the phrase
"with the President and the Speaker" is added to
clarify with whom the charges are filed.

As to subsection (b) of this section, note that
Section 2 of Ch. 818, Acts of 1982, enabled
individuals who held a classified position as of June
1, 1982, to retain that position.

As to subsection (c) of this section, Section 3 of Ch.
818, Acts of 1982 provided that, until the guidelines
were adopted, a removal of an unclassified employee
was to be reviewed by the President and the Speaker.
The guidelines were adopted on June 28, 1983, to be
effective on July 1, 1983.

2-1208. USE OF STAFF AND FACILITIES.

(A) AVAILABILITY.

THE STAFF AND FACILITIES OF THE DEPARTMENT SHALL BE
AVAILABLE TO PREPARE FISCAL REPORTS FOR AND OTHERWISE HELP:

JOINT LEGISLATIVE AND EXECUTIVE BODY THAT THE

GOVERNOR APPOINTS.

(B) REFERRALS BY DIRECTOR.

THE DIRECTOR SHALL ASSIGN, TO THE STAFF OF THE DEPARTMENT OR
TO A SPECIAL RESEARCH OR CONSULTING AGENCY, THE PREPARATION OF
ANY FISCAL REPORT THAT THE LEGISLATIVE POLICY COMMITTEE OR A
STANDING COMMITTEE REQUESTS.
