(3) NOTICE OF THE HEARING SHALL BE GIVEN TO THE
INDIVIDUAL AT LEAST 10 DAYS BEFORE THE HEARING.
(4) THE INDIVIDUAL MAY BE REPRESENTED AT THE HEARING
BY COUNSEL.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 40, §
59(e), (d)(2) through (4) and the second through
seventh sentences of (1), the fourth and fifth
sentences of (c), and the second sentence of (f).
In subsection (a) of this section, the words "staff"
and "staff and consultant services" are substituted
for the former list "officers, employees, ... and
special assistants", for brevity and conformity to
similar provisions elsewhere in the Code.
In subsection (d) of this section, which is derived
from the second sentence of former Art. 40, § 59(f),
the phrase "in the form and amount required by law" is
added as a general reference to the provisions of Art.
78A, §§ 10 and 46 through 50 and Art. 95, § 31 of the
Code. This addition is based on the first sentence of
former Art. 40, § 59(f), which required the
Legislative Auditor to be covered by a surety bond and
referred specifically to Art. 78A, §§ 46 through 50
of the Code.
Also in subsection (d) of this section, the correct
name of the Joint Budget and Audit Committee is
substituted for the former, incorrect reference to the
"joint committee on budget and audit".
Also in subsection (d) of this section, the former
references to "officers" are deleted as unnecessary,
in this context. Similarly, the former, specific
reference to staff of the Division of Audits is
deleted.
In subsection (f)(1)(ii) of this section, the phrase
"may be removed ..." is added as a general reference
to the removal provisions.
Also in subsection (f)(1)(ii) of this section, the
phrase "serves without a fixed term" is substituted
for the former word "indefinitely", to standardize the
references to tenure. This substitution is based on
the most recent enactment as to tenure, in former Art.
40, § 58(c) -- now § 2-1205(b) of this subtitle --
which was enacted by Ch. 818, Acts of 1982.
In subsection (f)(2) of this section, the reference to
