89 In the Chancery Maryland Whereas heretofore that is to Say in May Court in the yeare of our Lord one thousand Six hundred Seaventy five Edward Skidmore of the County of Cæcill did Exhibit his certaine bill of Complaint in the high and Hon.ble Court of Chancery Against Richard Foxon sonn & heyre of Richard Foxon William Chadborne & Susanna his wife thereby setting forth that the Comp.lt Edward Skidmore the last day of June in the one and fortieth yeare of the Dominion of Cæcilius &c Annoq Dom One thousand Six hundred Seaventy one for and in Consideration of Eight thousand pounds of tobacco to Richard Foxon of the County of Baltemore within this province planter paid & secured to be paid the Said Foxon did Assigne Sett and make over to the Comp.lt one hundred Seaventy five Acres of land lying in the said County called Bluntvile lyeing on the East side of Chesepiake Bay next Adjoyning to the land of William Ilills Southermost bounded wallnutt tree running South and by west downe the Bay for Breadth Eighty five Perches to A Marked Cedar tree bounded on the South by A line drawne East from the Said Cedar for length three hundred twenty Perches on the East by A Line drawn North from the End of the East line for breadth fifty five Perches untill it intersects A parralell drawne from the land of William Hills on the North with the said land & parralell on the west with the Said Bay Containing and laid out for one hundred Seaventy five Acres more or lesse formerly Granted unto Richard Blunt of the Same County by Patent under the Greate Seale of this province And Sold by y.e said Blunt unto Nathaniell Styles & by the said Styles Sold unto William Stanley & by the said Stanley Sold unto the Said Richard Foxon As appeares upon Record in the said County of Baltemore Together with all & singuler the houses Edefices wayes Easements & Priveledges to the said parcell of land belonging or any wayes apperteyning Only the said Foxon to remaine upon the said land untill the first of March one thousand Six hundred Seaventy two And then to ^give^ y.e Comp.lt A Sufficient Sale & assurance of the Same And the Comp.lt further setting forth that the Said Richard Foxon about the month of December one thousand Six hundred Seaventy one dyed before he had given the Comp.lt any Assurance of the said land And made noe will leaveing behind him Richard Foxon his sonn an Infant of very tender years and Susanna Foxon his wife to whom Administracon of all and Singuler the Goods Chattels & Creditts of the said Richard was by the Cheife Judge for Probate of Wills & Granting Administracon Comitted who hath since Intermarryed with one William Chadborn And the Said Richard Foxon being an Infant as aforesaid and the Said William Chadborne & Susanna his wife Relict of the Said Richard deceased not haveing Right to Convey the Said land to the Complainant And the Comp.lt haveing noe bond under the hand & seale of the said Richard Deceased for y.e Conveying the Said ^Land^ to the Comp.lt And Since his wittnesses to the Same bargaine may dye before the Said Richard Foxon heyre may arrive to full Age to Convey & secure the Said Land to the Comp.lt And in regard that the Comp.lt hath paid & secured to be paid the whole purchase money of the said land as the Comp.lt is ready to make appeare And the said William Chadborne & Susanna his wife Relict of the said Richard as yett Keepe (possession) |
