876 of Robersons Rest And at the End of the East Line Drawn one hundred fifty perches which said Tree he did then bound for the second bounded Tree of the Land called Goodluck which said Tree stood within thirty or forty foot of the place where this Deponent now standeth And further this Dep.ot saith that the bounded white oake which stands in the branch called the Beach Branch That John Rose would have to be the Second bound Tree of said Goodluck is not the bound Tree of the Land Goodluck for that he the said Depon.t never bounded the oake in the Swamp nor cause the same to be bounded And further saith that he never see the Said Tree before this Present time and that the second bound Tree which he the Said Depon.t bounded for the second bounds of the Lands Goodluck stood on high Ground and in the Place aforesaid And farther this Deponent saith that the third bound Tree of the Land Goodluck was a hickory which this Depon.t bound for the third Corner tree of said Goodluck at the time this Dep.ot surveyed the Land aforesaid and that the Said Hickory stood near to old Richard Stallins Dwelling house and farther saith that the Hickory which stands by the path side that John Lawfell sweares is not the bounded hiccory of Goodluck this Depon.t also saith that that hiccory by the Path Side is not the hicory that he the Said Depon.t bounded for the third Corner Tree of the Land called goodluck when he the Said Depon.t laid the said Land out And further this Depon.t saith that old M.r John Leach the father of this Present John Leach was never in Company with him the said Depon.t on the bounds of the Land called Goodluck nither on the originall survey nor since the originall survey And further saith not W.m Turner (S) George Young (S) Octo.r 11.th 1712 The Deposition of William Whittenton Sen.r aged sixty three year or thereabouts who being Deposed on the holy Evangelist Declares as followeth that about Twenty odd years agoe this Present M.r John Leach did tell this Deponent that if that Land of Thomas Horner which is the Land now in dispute were his the said Leaches he the said Leach would have that Land pointing to the Land before the said Horners Door of his dwelling house which was near about the place where John Rose now doth dwell and hath Cleared and Tended before the said Horners Dwelling house who was the owner of the said Land called Goodluck and farther saith not W.m Turner (S) George Young (S) |
