834 Affirmed that then he the said Nicholas shall not pay all Costs Charges and Damages which have accrued and shall accrue on the Decree aforesaid and also on the affirmation of the same Dennis Kerney upon his petition to sue in forma paupris ag.t the Widdow of Dennis Dwane ^being Read^ is admitted accordingly And M.r Wornell Huntt and M.r W Bladen assigned his Councill Thomas Emms v Decreed that the Defendant be foreclosed of James Richardson all Equity or power of Redemption and that Thomas Emms the Complainant Enjoy the premises according to the Covenants in the Indenture of Mortgate & Assignment and of Thereof against the said James and all Claimes by from or under him and that the said James Deliver to the said Thomas Emms the patents Deeds Evidences & writeings concerning the same if in his hands or Custody And that the Compl.t pay to the Defend.t his reasonable Costs in this suit Expended by reason of his Confession of the allegations in the Compl.ts Bill having aided his Suit herein Appearances WH William Sweatnam & John Whittington Inj.o Administrators of Edward Bathurst v TB William Fishburne Ex.r of Edw.d Bathurst and W.m Fishburne in p p WH John Warren Att the Motion of y.e Defd.ts v att.ry And the Argument TB Samuel Hanson & ux.r & Walter Storey allegations on both sides Adm.r of Benjamine Warren being heard it is ordered The Injunction be dissolved |
