       Many threatning speechs obliged the Deputy Sheriff to lay
       both the attachments in his the said Gilbert Falkoners hands
       having as he said Effects Enough of the Compl.ts and this ag.t
       the Defendants desire or Consent that some time afterward y.e
       Compl.t nor any for him appearing at the provinciall Courts to
       the said Attachments Judgm.t was given for Condemnation
       of what was attached thereby in the Said Gilbert Falkoners
       hands and Ca Sa's ag.t the s.d Falkoner as Garnishee of the
       Compl.t were Issued out of the provinciall Court Directed to the
       Sherriff of Cæcill County which said Ca Sa's being in this Defd.ts
       hands and he Intending only to serve one of them and he desire no
       more but what Expence he was at viz.t for his Cost of suit
       Col Nathaniel Hynson the then Sheriff of Cæcill County
       required them from this Defend.t alleadgeing that they were
       her Majestys Comands directed to him and that he did not
       know but this Defend.t had broke open his Letters to gett them
       into his possession and having obliged this Defend.t to delive him
       the said Writts of Cap.s Ad Satisfaciend Imediately tooke the
       said Garnishee against this Defend.ts Express Direction & request
       and this Defend.t further saith that he did request the said
       Sherriff not to make any returne of the Said Writt not desireing
       any Advantage thereby or having any fraudulent Designe having
       never offered to the prov.ll Court but purely by the Mistake of his
       attorney that ever he had been Executed for the Sum of five thousand
       three hundred thirty Eight pounds of Tob.o But the Sherriff
       pretending a Considerable Debt from this Defend.t tooke the afd
       Occasion to get into his hands by the means afd about Nine
       thousand Nine hundred and seventy one pounds of Tob.o of the
       Compl.ts but did never deliver the Same to this Defend.t thô Some
