             Benjamin Braines      This cause being ready for hearing the
                         v                   Bill and Ans.r was is ordered to be Read
             John Atkey                the substance whereof follows Viz.t

       That John Atkey of Cæcill County planter being Justly Indebted
       to Benjamine Braines of London Merchant in the sum of four thousand
       Nine hundred and forty three pounds of Tobacco for which the said
       Atkey passed his obligation to the said Braines y.e Compl.t  Who
       in the month of March 1702 comenced a Suit in Cæcill County Cort
       against the said Atkey upon the said obligation where he obtained
       a Verdict and Judgment for five thousand three hundred thirty Eight
       pounds of Tobacco for principall and Interest and Eight hundred
       thirty seven pounds of Tobacco Costs of Suit  That the said Atkey
       thereon brought a Writt of Error Returnable to the provinciall Court
       for Correcting the Errors in the Said Judgment whereon on Consideracon
       of the Judges of the Said Court the same Judgm.t for diverse Errors
       in the record and process thereof was reversed and annuled and
       adjudged that the Said John Atkey should be restored to all that he
       had lost thereby that thereon the said Atkey tooke out a Writt of
       Restitution against the said Benjamin Braines to be Restored
       to the afd Sum of five thousand three hundred thirty Eight pounds
       of Tob.o the principall and Interest afd and the afd Eight hundred
       thirty Seven pounds of Tobacco Cost for which the said Braines had
       Judgment as afd the Said Judges of the Provinciall Court supposeing
       upon false suggestion & Information of said John Atkey that
       Execution the said Compl.t had Executed the Said Atkeys Tobacco
       for Satisfaction of the said Judgment that the Said Benjamine
       being a Forreigner and his Effects in this province in his factors the
       said Atkey tooke out an attachment against his Effects to the
       Value of Eight thousand pounds of Tobacco in the hands of a Certain
       Gilbert Falkoner the Said Benjamin Braines's Fact.r in the said
       County  That in the Month of Sept.r Anno Dm 1706 Seven thousand
