(71) of they being indemnified as aforesd as by y.e Said bill answerr & other Pceedings uppon y.e Same Remaining of Record in y.e Secretaries office Relacon being thereunto had may more plainly appeare And y.e Said Cause so standing att yssue uppon bill & answer A Day was by this Court Appointed for hearing thereof on which Day being y.e eleaventh Day of December in y.e year of our Lord 1674 This Cause coming to a hearing in y.e p.rsence of y.e said p.ts Richard & all y.e Defd.ts & their Attorneys in this Cause uppon Reading of y.e Said bill and answer and y.e will of y.e Said Coll John Price this Court was Fully Satisfied with y.e Ability of the Said Comp.lts to manage their owne Estate themselves and that it was Just and Reasonable that they should have possion thereof to Improve y.e Same for y.e best for their future livelyhood doe thinke fitt & itt is this p.rsent Day that is to Say on y.e Eleaventh Day of December in y.e 43.th Yeare of y.e Dominion of Cæcilius Absolute Lord & Prop.ry of y.e Provinces of Maryland & Avalon Lord Baron of Baltemore &c Annoq Dom 1674 By the Right Hono.ble Charles Calvert Esq Cheife Justice in Equity the Hono.ble the Chancello.rs and the Rest of their Associates Justices of this Court ordered Adiudged & Decreed that y.e Said Severall Defd.ts doth forthwith pay or Cause to be paid to y.e Said Comp.lts Richard & Ann Hatton y.e Said Sume of twenty thowsand Five hundred & Fifty pounds of tobacco in y.e Said acco.t menconed as also that they doe forthwith deliv.r unto y.e Said Comp.lts or their order the like quantity & Stock of Oathe horses hoggs & goods in the Said acco.t menconed according to Age & Number or full Satisfaccon for y.e Sume according to y.e true intent & meaning of y.e Condicon of y.e Said bond of Eighty thowsand pounds of tobacco entred into as aforesaid and that the Receipt or other Legall Discharge or Release under the hands and Seales of y.e Said Comp.lts shall be their Sufficient Discharge for y.e Same tobacco goods & Stock of Oathe & hoggs aforesaid and against y.e Said bond of eighty Thowsand pounds of tobacco And it is also further ordered & Decreed that y.e Said Defd.ts Doe also forthwith Quitt y.e possession of y.e Lands Plantacon & p.rmisses in y.e Bill mentioned & Bequeathed to her the Said Ann & Deliver y.e Same quietly and peacebly to y.e Comp.lts and uppon paym.t of y.e Said Sume of two and Delivery of y.e Stock of Hoggs & Catle goods & Plantacons |
