(653 That if it was not soe and that their was noe Issue to inheritt that she the said Catherine after the decease of her Children and their heires would give it her selfe for the sake of the Garnishes knowing very well the said Jane to be (if surviveing the Right heir for the Tenements and dispute and possesoned as afores.d Sworne before us R Ungle + John Bullen + Depositions taken on the behalfe of Coll Thomas Ennalls Maryland fs.t Dorchester County Nov.r 16.th 1709 By Virtue of a Comission obteineing by the honoble Thomas Ennalls Esq.r out of the high Court of Chancery to us the subscribed directed Wee doe in humble manner Certifie y.t the day and Yeare afores.d personally appeared before us Henry Hooper of the said County of Dorchester Gent Aged about sixty three years or thereabouts who being by us upon the wholly Evangelist Sworne upon his Oath doth say y.t some time in March One Thousand six hundred and seaventy he being in Company with Phillip Sapley the surveyor of the said County did assist the said Surveyor in Carrying the Chaine to survey a certaine Tract of Land called Phillips Borrough their surveyed for Phillips Calvert since deceased and called his Mannor of Phillips borrough lyeing on the south side of Transquaking River then called Chiccocomico or Phillips Creek And this Dep.t further saith that he saw the first Tree of the said Tract of Land bounded it being a White Oake and that the said Oake did stand about One hundred yards below the now Landing place of one Richard Meares upon the first firme Landing on the south side of the s.d River towards the Month thereof and further he saith not Sworne before Us the day and Yeare first above written as witness our hands and seales Jn.o Rider + Hu Eccleston + |
