       By the Complt secured to be paid at sev.rall times did agree to
             bargaine and sell to the Complt the said sev.rall tracts or
          parcells of land Adjacent to and Contiguous to one to the
       other Containeing in all the quantity of five Hundred acres
       together with all such Cattle Hoggs horses sheepe and other
       creatures as was upon the same at the tyme when he the sd
       Robert purchast it  And all and singular the dwelling houses out
       houses Tobaccoe houses Gardens Orchards Barnes Stables w.t
       Cropp of Toba and Corne was then upon the same with w.t
       household stuffe at the tyme of such agreement was in the
       dwelling house or houses further agreeing to repaire the
       said houses and the said land and evry part thereof to the
       Complt for ever after to warrant and Defend and such
       Deeds as were requisitt for the secureing the premisses to
       Execute and the same to acknowledge in such manner and
       forme as by the act of Assembly in such cases made and pvided
       Inconsideracon of all which the said Complt for secureing the
       purchase Tobaccoe to the said Defend.t Robert did bind himselfe
       in four penall bonds each of them Conditioned for the payment
       of Twelve Thousand five hundred pounds of Toba Annually
       untill the said quantity of Fifty Thousand pounds of Toba
       should be Compleatly satisfyd and paid un pursuance whereof
       the Complt Alexander Forbes has pd him at least the
       quantity of Eighteene Thousand pounds of Tobaccoe as will
       make appear but soe it was that the said Robert Smith
       had not any wayes pformed his Agreement to the Complt by
       Executeing and Acknowledging such deeds as are requisite for
       the secureing the premisses to the Complt Though to doe y.e
       same he had beene often requested neither had he delivered
       unto the Complt soe many Cattle hoggs horses sheepe and
       other creatures as were upon the same when he purchased
       it neither did here paire any of the houses upon the said land
       nor pformed any part of the agreement afd but on the Contrary
       he the said Robert Smith ahd most unjustly and on purpose
       to vex and molest the Complt  And to put him to unnecessary
       Charge and Expence Commenced Sev.rall Accons against
