       and that the s.d Peters at the same time delivered the said
       Dansey his Clearance from Virginia and the Lord Balltemores
       Officer

To y.e 17.th   That the said Peters did repair to the s.d Dansey at
       the place af.d the 20.th of July 1703 and then and there required
       the s.d Dansey to Clear the s.d ship pursuant to his promise

To y.e 18.th   That the s.d Dansey then and there refused & denyed to
       Clear the s.d Ship and allso upon the s.d Peters his demanding his Clearance from
       Virginia and the Lord Balltemores Officer w.ch had delivered the as af.d did refuse to
       deliver them to s.d Peters saying they belonged to him

To y.e 19.th   That the s.d Dansey refused to Clear the s.d Ship for want of Security
       for the Bills of Exch.a w.ch he had rec.d & negotiated as Considerable time before
       in full Satisfaction for the said Ship Rogers

To y.e 20.th   That the s.d Ship was detained in the Countrey and Cost the Convoy by reason
       of the s.d Dansey's Refusing to Clear the same

To y.e 21.st   That the s.d Ships Bottom was Eaten out by the Worms and very much
       damnified in so much that She was now bottomed at the Charge and Cost of
       the s.d S.r John Rogers by reason of the s.d Danseys refusing to Clear the
       same as aforesaid

To y.e Last   That the Cargoe of Tobacco on board of the s.d Ship was by reason of the
       Detencon af.d damnified in so much that to the best of this Deponants knowledge
       there is Two hundred hh.ds of tob.o Totally Spoiled & lost out of the s.d Ships
       Loading of Three hundred Ninety Seven hogsheads


             John Coade Sen.r aged about 56 years or thereabouts being Sworn on the
             Holy Evangelist deposeth and Saith

To y.e first Inter   That he knoweth the plaintif and Defendant

To y.e 2.d   That he knoweth the Ship Rogers and further Saith not

To y.e 3.d  4.th  5.th  sixth  7.th  8.th  9.th  10.th  11.th  12.th  13.th  14.th  15 & 16.th  Interrogatorys
       saith not

To y.e 17.th   That this Depo.t was at the Office of the John Dansey on or about the
       20.th of July 1703 and then and there did hear the s.d Peters desire the s.d Dansey
       to Clear the s.d Ship Rogers and further Saith not

To y.e 18.th & 19.th  That the Depo.t did hear the s.d Dansey refuse & deny to Clear the
       s.d Ship unless he had security for certain bills of Exch.a which S.r John Rogers
       his Agent had passed some time before to the s.d Danzey and that he also tword
       the s.d Peters demand his Clearance from Virginia and the Lord Balltemores
