17.   Whether the said Peters did repair to the s.d Danzeys Office the 20.th
        Day of July 1703 & then and there request & desire the s.d Danzey to Clear the
        said ship Rogers pursuant to his promise?

18.   Whether the s.d John Danzey did not then and there positively refuse & deny
        to Clear the s.d ship and if the s.d Danzey upon the s.d Peters his demanding his
        Clearance from Virginia and the Lord Baltemores Officer w.ch the s.d Peters had
        deliver'd the s.d Danzey as af.d did refuse to deliver the same to s.d Peters?

19.   Whether you know have heard or been informed under what p.rtence
        or Motive the s.d Danzey refused to Clear the s.d Ship?

20.   Whether by the s.d Danzey's refusing to Clear the s.d Ship she was
        relieved in the Countrey & lost the Convoy?

21.   Whether by the Detencon af.d the s.d Ship was not very much
        Damnified and her Bottom Eaten out by the Worm and if by the reason
        af.d the s.d S.r John Rogers was not Compelled to be at the Charge of
        new bottoming the said ship or by what other Reason?

Lastly.   Whether the Cargoe of Tob.o on Board the s.d Ship was by reason of the
        Detencon af.d Damnified & in a great measure spoiled?  Declare what you
        know relating thereto and to all the aforemenconed p.rmisses


                 Depositions of Wittnesses taken at the house of M.r Gerard
       Slye in S.t Mary's County by Vertue of a Comission directed to me out of the
       high Court of Chancery to Examin Evidences in perpetuam Rei Memoriam
       in a Cause depending in her Maty's Prov.ll Court between S.r John Rogers
       Barronet plaintif and John Danzey Gent Defend.t on the part and
       behalf of the plt.f w.ch Comission bears date the 16.th day of June 1705
       I have by Vertue thereof this day (to witt) the 7.th of July 1705 sumoned &
       Caused to come before me the following Evidences (viz.t) Abraham
       Peters aged about 49 years being sworn on the holy Evangelist deposeth
       and Saith

       To the first Inter   That he knoweth the plaintif & Defend.t

       To y.e 2.d   That he knows the ship Rogers and that she Arrived in this province
             the 15.th of October 1702

       To y.e 3.d   That the s.d Ship was Condemned to be forfeited the 13.th of November 1702
             by a Court of Vice Admirallty held at Annapolis in Ann Arundell County one
             third part thereof to the Queen's Maty one third part thereof to the then
