539 in Compensation for what the s.d Willsons Eighty five Acres should take in of the s.d James's Land to Convey unto him all her Right TItle Claime Interest Demand or Pretension in the remaining Part of the s.d Tract called Pascalls Purchase not by her disposed of to the s.d Willson Vernon and Jones and the s.d James Heath making to her reasonable satisfaction for what the said remaining part should be esteemed worth more than that w.ch the s.d Eighty five Acres of the said Willson should take in of the s.d James Lands whereupon the said James and the s.d Susannah came to an agreem.t that the s.d James should convey unto the said Willson so much of the s.d James's own proper Lands as the s.d Eighty five Acres fell short within the bounds of the s.d Tract called Pascalls purchase and paying unto the s.d Susannah the Quantity of three Thousand pounds of Tobacco which was agreed to by the s.d James Heath not so much for the value of her Right in the remaining part of Pascalls purchase unsold as for his Comiseracon of the low & distressed Estate to which the said Susannah was reduced and the s.d Susannah should Convey unto the s.d James all her Interest in her s.d remaining part of pascalls purchase purselent pursuant to which the said James has agreed firmly to settle upon and Convey to the s.d Willson so much of his own proper Lands as makes up the s.d Willsons full Eighty five Acres whereby the said Susannah is made secure from any Trouble or Molestation which the s.d Willson might otherwise put her to and is ready upon demand to pay the s.d Tob.o so as afores.d agreed for and the s.d Susannah likewise pursuant to the s.d Agreem.t has Conveyed ^un^to the s.d James Heath in due form of Law all her Interest in her remaining part of Pascalls purchase unsold as aforesaid but that the s.d Tracy the s.d Susannahs now husband having absented himself so as af.d so that he cannot be found to Execute the s.d Deed in Conjunction with the s.d Susannah as the Law in such cases requires althô the Right and property of the said Land is in the said Susannah in her own Right as Devisee of her s.d first Husband Surick and consequently the said James his Title from the s.d Susannah (notwithstanding the valuable Consideration by him paid for the same and the absolute necessity requiring it as well for the Security of the said Willson as the Indemnity of the s.d Susanna may hereafter be disputed and called in Question wherefore he prayed that his Deed from the s.d Susannah would be confirmed by the Decree of our high Court of Chancery all w.ch allegacon of the s.d James are by the Answer of the said Susannah thereunto acknowledged and allowed to be punctually true as in and by Hers.d Answer filed in our said Court of Chancery it doth more at large appear and forasmuch as it (hath |
