401) Maryland ss At a Court of Chancery held at Annapolis Sept.r y.e 12.th in y.e tenth year of y.e Reign soveraign Lord William y.e 3.d King of England &c Annoque Dom.i 1698 Decree for James Brown Compl.t Whereas James Brown of S.t Maries County ag.t Gentl hath set forth (by his certain bill of Mary Denton wife of Complaint into y.e high Court of Chancery lately Hen.r Denton decd exhibited) y.t Henry Denton late of Ann Arundell Deft County Gentl decd did contract & agree to sell make over & convey to y.e s.d James & his heirs forever two Acres of Land being two Lotts laid out according to Act of Assembly in y.e City of S.t Maries with one dwelling house & other outhouses thereunto belonging for y.e Considearation of Twenty pounds sterl & a silv.r Tankard of five pound price or value sterl And y.t by order of y.e s.d Henry in a Letter of y.e s.d Henries directed to y.e s.d James he did enter into possession of y.e s.d dwelling House And y.t y.e s.d Henry happened to die intestate before y.e Conveyance of y.e premisses could be perfected leaving one Vachel Denton his son an Infant of about two years old his heir & Mary Denton his Relict who as Adm.rx of y.e Estate of y.e s.d Henry & as Guardian of y.e s.d Infant & for his own Dower or thirds of y.e s.d Estate claimes Right to y.e premisses or to y.e purchase Money to be paid as afd And y.t y.e s.d Mary being conscious of y.e agreement afd is willing to consent to such act for y.e setling y.e premisses upon y.e s.d James as y.e Hon.ble Judge & Justices of this Court of Chancery shall decree & direct And Whereas y.e s.d James therefore prays to have y.e same setled upon him y.e s.d James upon his paying y.e Consideration afd And whereas y.e s.d Mary Denton Deft confesseth y.e tenth of y.e s.d Compl.nts bill in all & every part thereof & y.t she hath not any thing to object ag.st y.e prayer of y.e s.d Compl.t therein & y.t shall will be contented with one third party of y.e purchase afd As by y.e s.d bill & answer filed in y.e Chancery Office more at large doth appear And whereas y.e s.d Agreement between y.e s.d Henry & James is alledged by y.e Oath of M.r John Stanley Assistant Clerk under y.e s.d Henry in his Lifetime which together with y.e aforesaid Letter of y.e s.d Henry is here set down at large in these words (viz.t) Battle Town Jan.r 11.th 1697/8 M.r Brown S.r yours of y.e 8.th Instant I recd but shall not to be at any Charge for drawing Writings Besides shall expect y.t y.e bills be drawn & delivered imediatly |
