394 Maryland ss Whereas Henry Mitchell of Calvert County Hen.r Mitchell Gentl did in y.e Month of May Anno Dom.i 1697 exhibit his ag.t bill of Complaint into y.e high Court of Chancery therein James Marks & praying to be relieved ag.t y.e unjust Claime of James Marks & John Ingram John Ingram of Talbot County to a certain tract of Land called Clories Point containing 600 acres being part of Hierdier Loyd Decree Mannour For y.t (as he y.e s.d Mitchell in his s.d bill alledgeth) he according to y.e y.e s.d Mitchell did actually pay 19000.ℓ of tob as purchase of 300 Minutes in of y.e s.d 600 acres to one William Ellingsworth who had before pag 386 y.t purchased y.e same from one John Ingram Father of John Ingram abovenamed as y.e s.d Ingram before y.t had purchased y.e same from one Clory Dorey who formerly purchased y.e same from Edward Lloyd (y.e grand Pattentee) gentl And likewise because about 1000.ℓ of Tobacco Costs of suit to one John Marks Father of y.e afd James Marks as purchase for y.e other 300 acres part of y.e 600 acres afd y.e s.d John Marks having been joynt purchaser with Clory Dorey afd of y.e s.d 600 acres And y.e s.d John Ingram y.e Father being supposed to be dead & John Marks & W.m Ellingsworth really both dead & y.e s.d Ellingsworth dying before y.e said Mitchell could obtain a Conveyance of his part of y.e s.d Land And for y.t severall Witnesses examined by virtue of a Comission issued to y.t purpose have fully manifested y.e Right of y.e s.d Mitchell & y.t unjust pretentions of James Marks & John Ingram y.e son to y.e s.d tract of Land Therefore y.e s.d Court of Chancery this 30.th day of August An° Dm 1698 upon hearing y.e said Mitchells bill & severall of y.e Depositions touching this Cause doth order & Decree That y.e s.d Hen.r Mitchell Complt as afd shall have enjoy & continue to him & his heirs Assignes &c y.e quiet & peaceable possession of y.e s.d tract of Land containing 600 acres in Talbot County afd called Clories point according to y.e Intent of his prayer in his bill aforesaid & y.t neither y.e s.d Marks nor Ingram ^nor any pson claiming by or under y.m or either of them^ do molest or hinder the same Likewise That y.e s.d Defts shall pay four thousand Three hundred twenty eight pounds of tobacco to y.e s.d Complt for his Cost & Charges in this behalf expended Signed P Hen Jowles Chanc.ll (viz.t)
