y.e s.d Lynes who said he would carry y.e same himself but this Deft
heard no more of y.e s.d Lett.r or any Answer thereof from y.e s.d Hill either
from y.e s.d Lynes or Hill till after y.e expiration of y.e s.d term of three years
       y.t y.e s.d Carvil having demanded possession of y.e premisses y.e s.d Lynes denyed
so to deliver them up sufficiently repaired as in y.e s.d Articles he had Covenanted
to do  Whereupon y.e s.d Compl.ts were compelled to bring an action
of Covenant ag.st him upon y.e s.d articles  To wch he pleaded Conditions
       performed & y.e s.d Compl.ts assigned y.e breach of y.e same for not paying
       y.e Rent & performing y.e Covenants in Repairs &c as in y.e s.d Articles
mentioned  And y.e s.d Complts brought one other Action of Ejectm.t ag.st him
for y.e Recovery of y.e possession of y.e premisses  And both Causes being ready
for a tryall in y.e pvinciall Court a little before y.e s.d Trÿall y.e said
Carvil heard y.t y.e s.d Lynes had given out y.t he had y.t under our hand
y.t would cost us in y.t Court  And y.e s.d Carvill being not conscious to himself
y.t he had done any act y.t could bar us of a Recovery in those acting and not
knowing or ever heard of any thing y.e s.d M.r Hill had done in y.e same sent to
y.e s.d Hill about y.e same who sent a Copie of y.e s.d Carvils Lett.r writt to him as
afd copied over by Lynes's Man & left with y.e s.d Hill whom he had by sinister
perswasions procured to under write y.e s.d Carvils Letter as a Consent of both
to grant y.e s.d term of five years more y.e s.d Compl.ts having been at Charges of sending
a Messenger to y.e s.d Hill above 35 Miles twice about y.e same to his great
Charge and upon y.e perusall of y.e s.d Copie there was no mention of any
thing writ by Hill so y.t y.e Complt Carvil proceeded to tryall of y.e s.d Causes
       & y.e Compl.ts expecting y.e s.d Lynes would have made good his plea afores.d
of Conditions performed & y.e pl.ts Witnesses being present y.e s.d Lynes produced
       y.e s.d Letter writ as afd & underwrit by y.e s.d Hill & urged y.e same as a good
Lease for y.e s.d five years more of wch as they alledged there was four years to come
       And thereupon y.e Court & Jury mistaking y.e Law in y.t Case & y.e Def.t
Lynes not proving any part of y.e Conditions in y.e s.d Lett.r to be done & performed
till all wch done & performed y.e pl.ts could not by law be obliged
to grant y.e s.d Lease & with a Lease under hand & seal acknowledged & Recorded
y.e same could not operate in Law ag.st y.e Compl.ts Right & title
to y.e premisses yet y.e Judge contrary to Law & Justice gave directions to y.e
Jury to find it a good Lease & so y.e Compl.ts were forced to suffer two Nonsuits
       in y.e s.d Actions & y.e Deft got Judgm.t thereupon ag.t y.e pl.ts &
hath ever since kept y.e possession of y.e s.d Mills & houses being now about
ten years though at y.e expiration of y.e s.d five years y.e pl.ts demanded possession
of y.e s.d Mills & houses but could not have y.e same For Relief within
& for y.t y.e originall Deed of Mortgage was lost & not recorded &
have an account of y.e s.d Mills & premisses from y.e time of y.e expiration
       of y.e s.d first three years & y.t y.e Def.t might have y.e same delivered
in good & tenantable repair as he was obliged by y.e s.d articles they being very
ruinory & out of repair and y.e Complts might be herein relieved according
Equity they prayed a spa ag.t y.e Deft to answer y.e p.rmisses wch being
granted & y.e Deft therewith served he appeared accordingly & put in a
       insufficient answer to y.e s.d bill  To wch Answer y.e s.d Compl.ts
put in exceptions & y.e s.d Deft being in Contempt for want of
putting in his second Answer  To both wch Answers y.e s.d Compl.ts
                                                                                                          did
