375) Decree for Davis ag.t Manthorp Maryland ss At a Court of Chancery held at Annapolis May y.e 21.st 1696 before y.e Hon.ble Coll Hen.r Jowles Keeper Kenelm Chiseldine & Edward Dorsey Gent Justices Between Sam.ll Manthorp Adm.r Compl.t of Rob.t Burman decd & John Davis Deft/This Cause coming this day to be argued upon y.e bill Answer & Replication The Court after long debates on both sides & having fully heard & considered y.e Depositions alligations & pleadings on both parties behalf by Witnesses Attorneys & Councill And being of opinion y.t y.e Deft Davis was first named by mistake & not indeed Principall in y.e bond for sixty seven pounds sterl passed by y.e s.d Deft & Rob.t Burman decd for payment for three Negro servants bought (as his alledged in y.e bill) by s.d Davis, doth think fit & so order adjudg & decree That y.e Complainant Adm.r as aforesaid shall give security to indemnifie y.e Deft from y.e bond passed by y.e s.d Deft to y.e Lord Baltemore & Company for y.e payment of y.e severall bills of Exchange for sixty seven pounds sterl & y.e Costs of y.e protest (viz.t) y.e Fees of y.e publick Notary (not y.e twenty P Cent) And y.t each partie in this suit shall pay their own Charges Seale w.th y.e great seal & signed Hen Jowles Chanc.llr Recorded P John Freeman Regist.r At |
