345) John Taman Bill & Answers Repl & y.e Deposit.rs all filed ag.t All which being read by y.e Regist.r in Court & long debates on John Sollars & both sides ended The Court Decreed y.t John Sollars one of Nic Fountain y.e Defts shall recover ag.t Taman y.e Complt all Cost & Damages whatsoever sustained by y.e premisses To be taxed at y.e next Court And also y.t all y.e s.d Cost & Damages recovered by Sollars ag.t Taman be reimbursed & paid by Nicholas Fountain y.e other Deft to Taman Thus for y.e Minutes The Decree & Costs & Damages are as follow Maryland Jn.o Taman J Sollars Decree Whereas heretofore that is to say y.e 26.th Day of May 1694 Jn.o Taman N.s Fountain of Calvert County planter Exhibitted his Bill of Comp.lt into this hono.ble Co.rt ag.t Jn.o Sollars Gentl & Nich.o Fountain planter Defts Thereby setting forth that Cæcilius late Lord prop.r by his pattent under his great seale dated the 20.th Day of Octob.r 1688 Did grant to one W.m Lowry of y.e same County planter a pcell of Land called Lowryes Chance lying in Fishing Creek next the Land of Francis Swinfer on the west on the Land of Arthur Thompson on the North begining at y.e s.d Thompsons white oake bound tree w.th a line by the s.d Thompsons land south west for the Length of 160 pches to a bounded white oake in the North line of the Land of Richard Smith & w.th y.e s.d Smiths line North for the Length of 320 pches to a bounded white oake on the North thence w.th a Line Drawn North west for y.e length of 150 pches to a marked white oake in the south lyne of the s.d Swinfers land on y.e East thence w.th the said Line South for the Length of 320 pches to y.e first bounded Tree containing & Laid out for 300 Acres more or less And the s.d W.m Lowry being thereby becom seized of the s.d Land Did the 20.th of March 1682 for the Consid.racon of 9000.ℓ of tobacco p.d by y.e Comp.lt bargaine & sell the said land to the Comp.lt his heirs & assigns forever w.th a Gen.rall warrant & other usuall Covenants in the Deed made thereof As by the same may more at Large appear & at the same time the s.d W.m Lowry gave the Comp.lt a Bond of 18000.ℓ tobacco penalty for pformance of the Covenants in the same Deed That the plt thereby become seized of the pmisses & y.e s.d Def.dt Sollers haveing a Desire to purchase y.e said Comp.lt agreed to sell the same to him accordingly & haveing shewed y.e s.d Sollers his title by the s.d Deed from Lowry according to y.e s.d Pattent the s.d Sollers ord.rd the like Conveyance to be Drawn for y.e Comp.lt to seale to Sollers as Lowry had done to y.e Comp.lt w.th like Covenants & Gen.ll warranty as afd w.ch y.e Comp.lt for y.e Consideracon of 11000.ℓ of tob to him p.d by Sollers Did Seale & execute accordingly And the s.d Sollers Did then request of y.e Comp.lt a bond of 22000.ℓ of tob to pform y.e Covenants in the same Deed to w.ch y.e Comp.lt assented and Sealed knowing that he nor the s.d Lowry had not done any Act To |
