329) & make over unto y.e s.d Mercer a firm & indefeazable estate of Inheritance of in & to two severall tracts or pcells of Land in y.e s.d County y.e one called The Indian Range containing two hundred Acres y.e other being y.e Remaind.r of a tract of Land formerly belonging unto one Godfrey Herman but then vested in y.e s.d Peterson & y.t pursuant to y.e Comunication & agreement aforesaid he y.e s.d Mercer did satisfy & pay unto y.e s.d Peterson y.e s.d sum or quantity of Ten thousand pounds of tobacco yet Notwithstanding such payment y.e s.d Peterson utterly refused & denied to make over or convey y.e s.d two tracts of unto y.e s.d Mercer pursuant to y.e agreement aforesaid To all w.ch Complaint y.e s.d Peterson makes no other Answer than y.t at y.e time of making y.e s.d Agreem.t he was under y.e Age of one & twenty years as also y.t he had not received from y.e s.d Mercer y.e Consideration of ten thousand pounds of Toba afd nor any part or pcell thereof To w.ch y.e s.d Mercer replyed y.t y.e s.d Peterson at y.e time of y.e Comunication & agreement afd was of full Age as also y.t he had fully satisfied & paid unto y.e s.d Peterson y.e ten thousand pounds of tobacco afd &c.a Upon hearing of which bill Answer & Replication as also of all y.e proofs testimonies & depositions of both sides relating to y.e premisses as likewise of y.e pleadings & allegations of y.e Council as well on y.e part of y.e Complainant & on y.e pt of y.e deft before Coll Henry Jowles keeper of our great seal in our s.d province & his ascociates it was evidently made appear y.t at y.e time of y.e Comunication afd y.e s.d John Peterson was of y.e age of twenty & one years & y.t soon after y.e s.d Comunication & agreem.t y.e s.d Thomas Mercer y.e Complainant had fully & compleatly satisfied & paid unto y.e s.d John Peterson y.e Deft y.e s.d sum of ten thousand pounds of Tob for & in consideration of y.e two tracts of Land aforesaid Wherefore it is hereby adjudged sentenced & decreed y.t y.e s.d John Peterson y.e deft do make over convey & confirm unto y.e s.d Tho.s Mercer a firm estate of Inheritance in & to y.e s.d two tracts of Land in Fee simple by such deed or deeds as y.e s.d Tho.s shall by his Councel learned in y.e Law get prepared for y.t purpose at any time before y.e first day of Octob.r next & y.t he acknowledg y.e same according to Act of Assembly of this province in such Cases made & provided & farther y.t he pay unto y.e said Thomas Mercer y.e neat quantity of Two Thousand and Thirty pounds of tob.co for his cost & charges in this behalf laid out expended & taxed by our s.d Court all which he is in no wise to omit Given under our great seal of our s.d province this twenty seventh day of May in y.e eighth year of our Reign Annoq Dom.i 1696 Witness our trusty & well beloved Coll Henry Jowles Keeper of our said great seal in our s.d pvince of Maryland (signed) Hen Jowles Chanc |
