301) Owen Howes aged 46 years deposeth as followeth That Thomas Kersey having made a Ware for M.r W.m Dare yo.r Dep.t asked y.e s.d Dare what he paid y.e s.d Kersey for making of it M.r Dare replyd y.t Tho Kersey had bought a pcell of land of him & had not paid him for it & y.t y.e Wares making should goe for y.e Interest of y.e tob & farther saith not Owen Howes Sworn before us this 22.d day of June 1695 Jo.n Thompson Ed Jones Joseph Moore aged 50 years or thereabouts upon oath declares That sometime in June last this Dep.t did hear M.r W.m Dare speak to Tho.s Kersey to get an order from John sequence to discount some Tob due to him but y.e s.d Kersey replyed y.t that would be y.e ready way to cut his own throat & destroy y.e bargain of y.e land in discounting what he had allready paid towards it otherwise & farther saith not Joseph Moor Sworn to y.e truth of y.e above writen Deposition this 20.º day of July 1695 John Thompson Edw.d Jones Alexand.r Cambell aged 39 years being sworn upon y.e holy Evangelists saith That yo.r dep.t being at y.e house of M.r Thomas Innis about 3 or 4 years ago M.r Herman & M.r Dare had form discourse about Tho Kersey And he heard M.r Herman say to y.e s.d W.m Dare Why did he not make an end with y.e s.d Tho Kersey about y.e land & severall other words passed between them to y.t effect The s.d M.r Herman told y.e s.d Dare y.t if he would come to his tob house he would pay him there for y.e s.d Kersey but y.e s.d Dare refused Upon w.ch M.r John Thompson being psent he y.e s.d Thompson offered to lend Coll Herman as much ready tob as he should have occasion for to satisfy M.r Dare upon y.e acc.t of Tho Kersey but y.e s.d Dare would not accept of it Upon w.ch M.r Herman replyed y.t he would stand by & help y.e poor Man Tho Kersey & farther yo.r Dep.t saith not/ Alex Cambell Sworn this 20.º day of July 1695 John Thompson Thus stands y.e Cause between Kersey & Dare Continued till y.e next Court Rich.d Peacock Bill ag.t The bill of Peacock being not to be found by M.r Wriothesley Tho Taylor y.e last Regist.r in Chanc.ry when he delivered up y.e Chancery papers to y.e psent Regist.r & y.e psent Reg.r declaring to this Court y.t he has not recd now seen y.e s.d bill nor any other paper touching y.e s.d Cause The Court ordered y.t it be dissmist unless y.e s.d bill & shall be found by y.e next Court Edward Rookwood Bill ag Dismissed because of y.e death of y.e Def.t Will Smith Tho |
