S.t Maryes County fs The Declaracon of M.r Henry Spinke of S.t Maryes County taken before us John Watson and Philip Lynes of S.t Maryes County Gent especially apoynted by vertue of a Comission to us directed out of the high Court of Chancery to examine Evidences upon Oath concerning a certain pcell of Land lying in Calvert County called the Ripe that is now in dispute betweene John Ledgitt of Calvert County plantiff and Samuel Watkins of the same County Def.t on Ejectment Which said Comission is hereunto annexed By vertue of which Commission we caused the sd Henry Spinke Sen.r to come before us this Ninth day of November One Thousand Six hundred Ninety & Three who did at the sd time upon his Oath declare unto us &c being by us examined upon severall Interrogatoryes as touching the s.d Land & what he knew any ways relating to the same and is as written Foll 1.st Interrogatory this Deponent upon his Oath Saith That Nicholas Harvey was the Deponents Master and that he served the greatest part of his time upon M.r Harveys Land lying in Potuxent it being the same Land that since M.r George Beckwith and M.r Thomas Banks hath lived upon & that amongst severall neighbours there was much grumbling supposing that there was much more quantity of Land this sd Harveys Survey made mention of & y.e s.d Thomas Bankes coming to yo.r Deponent to enquir about the bounds of y.e s.d Harveys land & took a Certificate of the same out of the Office & according to y.e request of the s.d Banks I went w.th him & shewed him what I knew of y.e bounds of Harvey's land & shewed him the ould Potuxent Path & the place where the bound Tree stood of y.e s.d Harveys Land & the s.d Banks after I had soe showen him the s.d Land of Harveys I have heard that Thomas Banks took up some Lands adjoyning thereunto 2.d Interrogatory y.e s.d Henry Spinke Sen.r he well knew Nicholas Harvey & likewise knew all Manno.r of Land of y.e s.d Nicholas Harvey's soe far as I underneath make mention it being called S.t Josephs Manno.r one bound Tree thereof stood at the head of S.t Lawrence's Creeke runing from the said bound Tree along the former |
