287 plts nor according to the said Memorand.m or the Deeds of Canes purchase or Jericho nor did ever goe about to defeat the plts of any Lands or estate given by the same Memorand.m or two Deeds nor ever claimed any right or title to that pte of Canes purchase conveyed to the plts nor to the land called Jericho nor to half of Blueplaines till the plts sold the same to Giles Blizard as aforesaid and they deny that the said Giles Blizard ever threatned or desired the plts to deliver up any writeings from Ocane to Brayne and believe there was never any such for they cannot find any such amongst Giles Blizards papers and they deny any fraudulent attempts or Combinacons with John Ocane used by Giles Blizard to defeat the plts of any their Lands or that the said Giles Blizard ever enticed the said John Ocane from the plts house but have heard his remove was occasioned through the disobedience & morose behaviour of the plt Edward And they further say they have heard and hope to prove that upon the treaty of marriage between Giles Blizard and Susanna Ocane the said John Ocane did assure the said Giles Blizard that as he had given the plts half of Canes purchase and half of Bueplanes & all Jericho and half of his personall estate (which was then considerable) soe he would give the other half of Canes purchase and Bueplanes to his Daughter Susanna and accordingly the 28.th of April 1684 John Ocane by Deed of Guift indented reciteing his interest in Canes purchase and Bueplanes and setting out the bounds of both the said Lands and reciteing alsoe the estate made to the plts by the Deeds of the 28.th of April 1693 of his own motion and free will did Give and Grante to the said Susanna the other moiety of Canes purchase (50 Acres excepted lying next adjoyning to the plts moiety) and the moiety of Beuplanes to the said Susanna and her heirs for ever which Deed is acknowledged the alienacons paid and recorded And by vertue whereof she became seised of that moiety And the said Giles Blizard after their marriage in her right claimed the same And about September 1685 the said Susanna dyed leaving the said Susanna the Deft her heire That the said Giles after marriage the said Def.ts Mary at which time she dwelt on Canes purchase and about September 1687 the said Blizard made his Will and gave his moiety of Canes purchase to his wife for life remainder to his daughter Susanna ^the Def.t^ and his heirs and Died And by that right the Defts claime to keepe the Land and soe justifie the keeping possession thereof And to divers other matters and things in the Bill not here to for answered unto confessed or avoyded pticulerly the guift of a Moiety the Deed and all the rest of the Bill they are advised the same Certain many irregularities falsehoods and imposicons such as doe afford to the Defts sufficient cause to plead in barr to the former and therefore they Demurr in Law and for cause of Demurrer shew that the plts claime right to all Canes purchase and by their own shewing make title but to half of it Also |
