286 her naturall life and after her decease to the said Susanna Blizard his Daughter and heir And the said Mary being married to the Deft Robert they the said Robert and Mary in right of the said Mary claime the same for her life and as Guardian to the said Susanna an Infant under One and Twenty Years the Inheritance for her the said Susanna and therefore the sid Complts prayed reliefe against the said Def.ts who held the possession of the p.rmisses and that the said suite might stand revived against the said Def.ts in such manner of plight as the same stood at the time of the death of the said John Ocane and Giles Blizard and that the process of this Courte to revive the same suite might be awarded against the said Def.ts to appeare and answer the said Bill Which being granted and the said Def.ts therewith served they appeared accordingly & put in their answer plea and Demurrer to the said Bill & therein and thereby did sett forth that as to the Inducem.t & pswasions used by John Ocane to the plt to marry the said Jane the Contract promises writeings memorand.ms (if any such were) Consignments payment of Debts or other concerns or traffick between Brayne and Ocane (except the Bill for 20000.ℓ of Tobacco) they are wholly ignorant and are advised they are not obliged to answer the same But they believe the plt was lawfully marryed & that in Consideracon thereof the plts ingagements to accomodate the said Ocane with Meat Drinke Lodging and Cloaths dureing his life and paying his Debts the said John Ocane did give some writeing or Memorand.m that he would settle on the plts a Moiety of all his land which the said John Ocane accordingly did by his Deed dated the 28.th of April 1693 as in the Bill And as to the half of Canes purchase according to the Lines and bounds therein menconed they believe neither Giles Blizard nor doe the Defts claime any title to any land within those bounds and they believe the Deed was bona fide made but not upon the bare consideracon therein menconed but in consideracon of the marriage alsoe And as to the land called Jericho neither Blizard as they believe nor the Deft lay any claime thereunto That the Defts being married and inspecting Blizards papers they found an Indenture of Bargaine and Sale made betweene John Ocane and the plts dated the 28 April 1693 whereby the said Ocane did for the consideracons of the same Deed menconed give and grante to the plts and the heirs of her body lawfully begotten the half of the land called Blueplaines which said Deed the Defts believe the plts did deliver to Giles Blizard who in his life time as they believe for a valueable consideracon purchased the same of the plts for they found an Indenture made betweene the plts and Giles Blizard dated the 16 October 1684 whereby it was witnessed that the said Henry Brayne being obliged in 20000.ℓ of Tobacco to pay the said Susanna at her marriage & Giles Blizard and shee being married the Debts belonged to Blizard the said plts in Consideracon of a discharge of the said 20000.ℓ of Tobacco which ^he ware^ he and liable to pay as Adm.rs of Brayne did absolutely sell and Convey Blueplaines to the said Blizard his heirs and Assignes with a generall warranty which said Deed they believe that was freely done by the plts without any threats and they deneyed that the said Giles Blizard ever took any advantage of the |
