       the said Comp.lt hath been not onely Served with a Sup.a for the payment of the
       said Costs but also with a writ of Execution of the Said Decree & the Costs
       hath been Demanded of him but hee hath refused to pay the Same as by
       the Affidavit of James Crauford may appeare  Whereupon pcesse of
       Contempt issued out against the said Comp.lt for Nonpayment of the said
       costs and he hath beene taken upon the same and Lyes now in Prisson in
       the Custody of the Sheriffe of S.t Maryes County for nonpayment of
       the said Costs  And a writ of Execution of the said Decree hath beene
       Delivered to the said Comp.lt under the Seale of this Court Whereby he is
       Enjoyned to performe what on his part ought to be performed  And one
       George Curwen did upon the thirteenth day of Aprill last past by vertue
       of a Letter of Attorney under the hand and Seale of the said George Parker
       bearing date the Eighth day of Aprill last past Aske and Demand of
       the said Comp.lt if he would performe and yeild obedience to the said Decree
       and would pay unto him the said George Curwen for the use of the said George
       Parker the said Seaverall Sumes of Tenn thousand pounds of tobacco &
       Tenn thousand pounds of Tobacco Due by the said Order and Award to be payd
       by the said Comp.lt to the said Deft as also the said Twelve thousand six
       hundred fifty two pounds of Tobacco costs aforesaid  And the said George
       Curwen did at the same time tender unto the said Comp.lt a writeing with a seale
       to the same affixed purporting to be a Letter of Attorney whereby hee the sd
       Comp.lt was to Authorize and Impower the said George Curwen in his the  
       Comp.lts name and stead and as his Attorney to Enter into and upon all the
       Messuages Tenements Dwelling houses Orchards Yards Gardens Lands &
       premisses with the appurtenances mentioned and expressed in the Deed of Mortgage
       or Lease before recited Or into or upon soe much thereof as is not by the said
       Decree Ordered and Adjudged Or into any part thereof in the Name of the
       whole  And peaceable and quiet posession and Seizen thereof for him and in
       his name to take  And after such posession and Seizin thereof had & taken
       as aforesaid for him the said Comp.lt & in his Name Stead and place
       peaceable and quiet posession Livery and Seizin of all and Singular the said
       premisses or any part thereof in the name of the whole to deliver unto the
       said George Parker his heires or Assignes or to his or their Certaine
       Attorney in that behalfe  And to ratify and Confirme all and whatsoever
       the said Attorney should Doe or Cause to be Done in or about
       the p.rmisses  And the said George Curwen did then and there Desire
       the said Comp.lt to Seale and Execute the said Letter of Attorney to him
       the said George Curwen in manner aforesaid but the said Comp.lt Did
       Absolutely refuse to pay the said Twelve thousand six hundred fifty two
       pounds of Tobacco Costs or the said Twenty thousand pounds of tobacco
