       sumes of mony by the Complt lend out and disbursed in & aboute the
       said Ketch & voyage and for the Deft John Penroy the Complt had
       exhibited his bill into this Court of the said Defts and the said Def.t
       Thomas being brother of and part owner with the said John Penroy
       who was gone out of this Province being served with processe
       of spa to appeare & answer the said Complts bill with processe
       of this Court an Attachm.t with proclamacon for want of an
       Answere and had alsoe departed this Province and had
       alsoe brought two severall accons at the Comon law against
       the Complt for the supposed breach of a certaine Charter pty
       made between the said John Penroy and Robert Mason and
       for severall goods belonging belonging to the said Ketch
       as was alleadged to be lost & inbezelled to both which
       accons the said Complt had appeared and had putt in special
       bayle and could hee procure the said Penroys Answer to the
       said bill he was ready to speed the cause for hearing  And
       therefore it was prayed that the said severall bonds & bills
       putt into the secretary's office as aforesaid for security of
       the payment of seamens wages might be delivered to the
       said Complt to receive & recover the severall sums of Tobacco
       due upon the same towards the reimburse him what he had
       payd for seamans wages as aforesaid he haveing given
       speciall bayle as aforesaid and that if occasion bee hee
       may be impowred to sue the said bills in the name of the
       said John Penroy or in whose names soever the same are
       taken for the use for the recovery thereof  And the said Defts
       Attorny now p.rsent in Court not offering any reason to the
       Contrary  This Court held reasonable and doth order the
       same accordingly and that the severall persons concerned with
       the said bills or bonds doe pay what is due from them to
       pay to the said John or Thomas Penroy upon the said bonds
       or bills to the said Complt accordingly
