Jn.o Bennet The Comp.lt filed his bill ag.t ag.t the Defts this Court Tho Sterling Richd & the said Def.ts Thomas Johns & Andrew Sterling & Richd Johns Tenehill appeare by Geo Parker their Attorney 26.th November 1680 In Chancery Between Robert Mason Plt and John Penroy and Thomas Penroy Defend.ts Whereas att a Councell held att S.t Mary's the Fourth day of July 1679 before his Lopp the Lord Prop.ry the honoble the Chancellor Secretary and Coll Darnall upon mocon made by M.r Christopher Rousby the Defts Attorny that the Ketch called the Prosperous formerly entrusted by the Defts John Penroy with the Complt for a voyage to Barbadoes was then returned into the Province & lay in danger of being spoyled by the wormes & therefore he moved his Lopp and Councell that the said Vessell might be delivered to the Deft Thomas for the use of the Deft John Penroy that she might be serviced from the wormes whereupon it was ordered that the said Complt should forthwith deliver unto the said Deft Thomas the possession of the said Vessell to dispose of att his will & pleasure The said Thomas Penroy giveing security either by bills of Exchange & security for payment of such bills of Exchange as hee should drawe or good and sufficient mens bills of this Province for the true payment of all such wages as were due unto the Seamen for navigating of the said Ketch In pursueance of which ord.r the said Deft Thomas did deposite in the secretary's office in the hands of Nicholas Painter Clerke of the Prov.ll Court severall bills & bonds of severall sums of Tobacco due from severall psons in this Province to the said John Penroy amounting in the whole to the sume of 8508.ℓ pounds of Tobacco to bee as a security for the payment of the Seamans wages and thereupon the said Complt did deliver unto the said Thomas Penroy the possession of the said Ketch Now upon mocon made to this Court by the Complts Attorny in the p.rsence of the Defts Attorny It was alleadged that since the delivery of the Ketch aforesaid the said Complt had paid unto the master and Seamen that navigated the said Ketch from Barbadoes hither according to his contract with them for their severall wages the sume of Thirty nine pounds six shillings and Nine pence as by their receipts here produced & in Court appeared & for satisfaccon thereof and of diverse other (Sumes) |
