23 Joseph Edloe ag.t This Cause by Consent of Attorneys of both sydes was Continued John Halfhead untill the next Court John Robinson & Comp.lts Elizabeth his wife ag.t The defend.t Rozer appearing before this Court this day Benjamin Rozer & def.ts and Exhibiting to the Court here a list of what bad Thomas Sprigg debts their are belonging to the Copartnershup betweene John Lumbroze late of Charles County deceased, and Edward Richardson now Resident in Ireland as it is sayd according and in obedience to an order of this Court made the 21.th day of October last past, and the Comp.lt and his Attorney being then p.rsent to make their Exceptions to the same, and the Court bearing as well the Depositions bill answere and Replication in the said Cause as also the Report of Thomas Notley and Thomas Lomax gentl, Arbitrato.rs appointed by this Court to Examine state and audit the whole busines Depending betweene the Comp.lts and defend.ts and to make Report to the Court how they found it, the Court are all Clearly satisfyed, and doe hereby ord.r ordaine and Decree that Benjamin Rozer the Defend.t to pay unto Robinson Comp.lt six Thowsand and seaventy pounds of Tobacco, together with Two Thowsand Eight hundred Eighty Eight pounds of Tobacco for Costs of suite, and that this Decretall order or a Coppy thereof (attested by the Reg.r of this Court for the time being) produced in any Court of this Province save and Keepe harmlesse and forever indemnifyed the said Benjamin Rozer his heires Executo.rs Adm.rs or Assignes, ag.t the said Edward Richardson his Attorney ^or^ his heires Executo.rs Adm.rs or Assignes, or any pson claiming by from or under him them or any of them, as to the said sume of six Thowsand seaventy and foure pounds of Tobacco and Costs, being y.e proper goods and Estate of the said Richardson in the hands of the said Rozer (the Costs allowed as by by the bill of Costs taxed before his Excellency & Chancelo.r being two Thowsand Eight hundred Eight Eight pounds of Tobacco John Balley ag.t James Neale These two Causes Continued by a former ord.r untill February 6th James Neale ag.t John Balley Edward Peerce ag.t The Defend.t not appearing by himself or his Attorney in this Randall Revell Court, and their having been an Attachm.t already yssued out against him, It is ordered by the Court that a Proclamation issue out against the said Revell |
