(214 Ruine and Undoe the Comp.lt and seize upon his Reall & psonall estate Unlesse hee imediately sealed and at his Act and deed delivered the said Conveyance or Mortgage for the said six hundred Acres of Land soe Condiconed as aforesaid and in ord.r thereunto the said deft Tooke out Replevins for all the Comp.lts psonall estate and delivered the same to the high sheriffe of the County of Calvert to Execute and likewise brought an Ejectm.t ag.t the Comp.lt for the Eleaven hundred Acres of Land the whole Reall estate w.th all the houses buildings and appurtenances And the Comp.lt finding himself in this straight and that hee must unavoydably bee Ruined (the Deft haveing Taken away all the Comp.lts servants) The Comp.lt was forced To Signe seale and as his Act and deed to Deliver the said Deed Conveyance or Mortgage for the said six hundred Acres of Land for the Consid.racon and und.r the Condicon aforesaid but the Deft Would Give the Comp.lt use Coppy thereof Nor Receipt for the Consideracon Money Upon what account payd Nor any security to pay or allowe the said Tobacco to the Comp.lt but the said deft Told the Comp.lt that hee would Discharge the Comp.lt from all debts dues & Demands whatsoever and that hee would Release unto the Complt the five hundred Acres of Land the Remaind.r of the Reall estate & likewise would deliver up the Mortgage of the psonall estate & Discharge the Remaind.r of the psonall estate then in the Comp.lts possion And likewise Deliver up the bills Bonds specialtyes and other Writeings w.ch hee then had in his Custody and p.rtended to Keepe for his security Although in Truth hee the said Deft was payd much more then the Twenty five thousand Eighty and eight pounds of Tobacco the Consid.racon of the Mortgage of the whole Reall estate, the Deft Discounting the said Fourteene thousand pounds of Tobacco then in his Posession Belonging to the said psonall estate But the Deft still Kept in his hands the originall bills and specialtyes for Tobacco aswell what was p.rtended to bee due to him from the Complt as likewise the bills specialtyes and Ingagements of the Comp.lts to other psons Taken up by the said Deft and by him got into his hands soe as aforesaid for w.ch the Comp.lt had noe Discharges and the Deft did threaten to Comence suites for the same although for (those |
