(178 the said land and personall estate for foure thousand pounds of tob p ann dureing her life and thirty thousand pounds of tobacco to whome the should bequeath the same at her death and thereupon she discharged these Defts that the Deft gave her bond for sixty thousand pounds of tob to pay her foure thousand pounds of tob p ann &c and denyes they posessed themselves of any of the personall estate of the said Thomas or Carryed away any sarvants belonging to the said Thomas but Confesse that the Arbitrato.rs delivered these defts the bond of the p.lts for three hundred thousand pounds of tob, w.ch they have put in suite, that these Defts Entred upon the plantation called the Quarter and upon the sarvants Stock and Cropp and that there was about forty barrells of Corne and about thirty hogshds of tobacco that these def.ts received the same and ought not to bee accountable for the same to the Comp.lt Thomas, that these def.ts cutt downe timber by order of the Comp.lt Damoras, that they had posession delivered them by the Complt Damoras, and have her release and ought not to be accountable to the Comp.lts, and denye they detaine any provisions or weareing appell belonging to the Comp.lt Thomas And that the Comp.lts account exhibited before the Judge Testamentary was sett aside by the Award of Collon.ll Taylor and Collon.ll Burges, and denye they posessed themselves of any part of the personall Estate more then what wee delivered and Confesse the Comp.lt tendred bills to these Defts w.ch were Desperate and that these defts refused to allowe the same, that the Comp.lts wanting a woman sarvant did Exchange a man sarvant named booth to worke for these Defts soe long as the woman sarvant should stay and worke for these Comp.lts And the said woman belonging to the Comp.lt Thomas the said Comp.lt left w.th the Comp.lt Thomas his wife, to cure her of a sore legg, to which answere of the Defts there being much new matter these Comp.lts replyed specially and say that the Defts by sinister and fraudulent meanes caused the Comp.lt Damoras to signe and seale seaverall papers the Contents of w.ch she never heard read and utterly denye the said Receipts or releases can by Lawe any way discharge these Defts, that the Complt Thomas and Def.t Edward submitted all differences to the Chancello.r who Awarded the deft Edward to pay unto the Comp.lt Thomas tenn thousand seaven hundred forty six pounds of tob, that there was nine thousand pounds of tobacco were due upon the account but by neglect of the Clarke was omitted out of the accompt upon the Chancello.rs Award denye the said Defts payd the said tenn thousand seaven hundred forty six pounds of tobacco to the Complts or Either of them, that the Defts inticed the Comp.lt Damoras to give discharge for the same denye her receipt Can discharge the said bond, that the Comp.lts Exhibitted theire Just account of Wyats estate after (the |
