Proposed regulations setting out Rules of Procedure
for the Board of Chiropractic Hearings, published in the
April 1, 1983 Maryland Register, were held up by the
Committee on May 4, 1983, due to concerns about statutory
authorization, the use of summonses by the Board, and the
fairness of a 5-day period for filing a response in Board
proceedings. The Department had failed, as of June 15, to
respond satisfactorily to the AELR Committee's concerns and
so the Committee has refused to authorize final formal
adoption of the proposed regulations.
10. Department of Natural Resources: COMAR 08.05.05
Proposed regulations implementing the State's new
Stormwater Management Program were published in the May 13,
1983 Maryland Register. The AELR Committee asked on June 10
that final formal adoption by DNR be held up until the
Committee has had time to monitor and study the testimony
heard by the Department at 9 Departmental hearings held
between May 31 and June 9, 1983.
11. Department of Human Resources: COMAR 07.02.13 &
07.02.18/Department of Health and Mental Hygiene: COMAR
10.05.01
Proposed regulations concerning day care centers and
day care services for children were published in the April
15, 1983 Maryland Register by the Department of Human
Resources and in the May 13, 1983 Maryland Register by the
Department of Health and Mental Hygiene. In view of several
concerns which have arisen concerning day care services
throughout the State, the AELR Committee on June 1, 1983
held up final, formal adoption of the DHR and DHMH
regulations pending AELR review of the written and oral
testimony heard by the Departments concerning the proposed
day care regulations.
OTHER
1. Maryland Register - Cost Increase
Due to general fund budget cuts by the Budget and
Taxation and Appropriations Committees in the budget of the
Division of State Documents, the Division requested two
Maryland Register price increases which, were authorized by
the AELR Committee and are due to go into effect July 1,
1983.
(1) The average yearly subscription price of the
Maryland Register will increase from its current $55
per year to $75 per year; and
(2) The cost of publication of agency notices which
are not proposed or emergency regulations will be $20
per quarter page.
