but shall be maintained as a special fund, up to a maximum of
[$25,000] $40,000. Any excess over [$25,000] $40,000 shall revert
to the general funds of the State.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect June 1, 1983.

AN ACT concerning

|
|
|
Mental Retardation and Developmental
Disabilities - Facilities
FOR the purpose of defining "facility" for purposes of the Mental
Retardation and Developmental Disabilities Law to include
certain public or private places providing or purporting to
provide treatment for nonretarded developmentally disabled
individuals; requiring a license to operate a private
facility issued by the Mental Retardation and Developmental
Disabilities Administration only if the private facility
serves 4 or more individuals at any one time; and providing
that the definition of nonretarded developmentally disabled
individual set forth in Title 7, Subtitle 2A of the Health -
General Article shall apply to that entire title.
