the County Executive is responsible for in administering the
Chapter; and Section 8A-19, title "General Provision", Subsection
(g), title "Penalty; Security Deposit", to provide for revised
security deposit features, and Subsection (h), title "Civil
Remedy", to provide for comprehensive remedies for franchise
violations. Effective Date December 21, 1981.
BILL NO. 42-81 AN EMERGENCY ACT to amend Chapter 54A, title "Transit
Facilities" of the Montgomery County Code (1972), as amended, by
adding new subsections 54A-5, title "Bicycles, Motorcycles and
Similar Vehicles" and Section 54A-6, title "Roller Skates and
Skateboards" for the purpose of prohibiting the parking or use of
certain vehicles in rail transit stations or public passenger
vehicles, owned or operated by the Washington Metropolitan Area
Transit Authority, except under certain circumstances and in
accordance with a permit issued by the Washington Metropolitan
Area Transit Authority. Effective Date July 1, 1981.
BILL NO. 43-81 AN EMERGENCY ACT to amend Chapter 6A, title "Beverage
Containers" of the Montgomery County Code 1972, as amended, for
the purpose of amending Sections 6A-3, title "Refund Value
Required", 6A-4, title "Acceptance for Refund", and 6A-5, title
"Non-reusable Beverage Container Markings", to delete provisions
establishing October 1, 1981 as an implementation date; Section
6A-6, title "Metal Nonreusable Beverage Containers With
Detachable Openings; Prohibited", to clarify who may not sell
certain kinds of nonreusable beverage containers; Section 6A-9,
title "Investigation and Report By County Executive", to require
certain reports by the County Executive and eliminate the need
for certain actions by the County Council; and to add a new
Section 6A-10, title "Enforcement Date" to provide that Sections
6A-3, 6A-4 and 6A-5 shall not take effect until the County
Council adopts a resolution declaring that a sufficient number of
surrounding jurisdictions have enacted substantially similar
legislation. Effective Date September 28, 1981.
