BILL NO. 60-80
AN EMERGENCY ACT to amend Chapter 24, title "Health and
Sanitation" of the Montgomery County Code 1972, as amended, by
repealing and reenacting with amendments Section 24-22, title
"Legislative findings; purposes and intent, to delete language
relative to the transition from comprehensive health planning
legislation and to correct the reference to Department of health,
education and welfare to Department of health and human services;
Section 24-23, title "Definitions," to modify the definitions of
the word "Act" and the phrase "Provider of health care"; Section
24-25, title "Health services planning board - Established;
selection process; composition," to increase the number of Board
members from twenty-three to twenty-nine, to include Board
members representative of the handicapped and labor and business
organizations, to permit the County Council to be represented on
the Board by a Council member or its designated representative
and to permit additional ex-officio non-voting Board members from
public agencies concerned with health matters; Subsections (a)(3)
and (a)(4) of Section 24-31, title "Same - meeting and conduct of
business," to permit the Board to conduct executive sessions
where matters of performance or remuneration of employees are
concerned and to withhold from the public data and records
relative to the performance or remuneration of employees;
Subsections (a)(2), (a)(4), (b), (d) and (e) of Section 24-32,
title "Same - responsibilities and authority," to require the
Board to consider issues relating to competition in the health
services industry and to delete provisions relative to what the
Board should consider when developing, adopting, and publishing
criteria and procedures for review of proposed health system
changes; to make clear that while the board shall not be
responsible for the execution or promulgation of personnel rules
and practices relative to department staff and other internal
affairs the board may take such matters into consideration; to
delete a reference to comprehensive health planning functions;
and to make other technical changes to conform the County law to
the National Health Planning and Development Act, as amended
(P.L. 93-641 and P.L. 96-79).
Effective Date December 23, 1980.

BILL NO. 62-80
AN ACT to amend Chapter 49 of the Montgomery County Code
1972, as amended, title "Streets and Roads", by repealing and
reenacting with amendments Section 49-55, title "Assessment of
costs by County Council; appeals" to allow the County Executive
two hundred seventy (270) days to forward final recommendations
for the assessment of costs to the County Council; and Section
49-52, title "Road Construction to be Authorized by County
Executive; Council to Assess Benefits" to establish a presumption
of no benefit for certain condominium and cooperative units.
