ANNE ARUNDEL COUNTY 2949
subheading reference to the Board of Appeals; to provide for an
advisory commission to assist the Executive and Legislative
Branches of County government in matters concerning County
pension plans; to provide for the membership, operations and
functions of that Commission; to provide generally for a Pension
Oversight Commission; and to submit these amendments their
adoption or rejection. Approved August 16, 1982.
Bill No. 84-82 AN ORDINANCE to amend the Charter of Anne Arundel County,
Maryland, by repealing and reenacting, with amendments, Article
VII, "Budgetary and Fiscal Procedures", Section 717 (c),
"Enterprise Accounting"; to reduce from a three-year basis to a
yearly basis the requirement that utility rates be adjusted if
any utility operates at a net loss, to amend the present language
to clarify that this provision applies separately to each utility
fund and to clarify the manner in which a loss is determined for
purposes of this provision, PURSUANT TO A PROPOSAL OF THE ANNE
ARUNDEL COUNTY CHARTER REVISION COMMISSION, TO REMOVE FROM THE
CHARTER THE REQUIREMENT THAT UTILITY RATES MUST BE ADJUSTED AT
LEAST EVERY THREE YEARS IF THE UTILITY HAS OPERATED AT A NET
LOSS; TO SUBSTITUTE A REQUIREMENT THAT IF FOR ANY FISCAL YEAR A
UTILITY FUND HAS OPERATED AT A NET LOSS AND SHOWS A DEFICIT, THE
COUNTY EXECUTIVE SHALL RECOMMEND, FOR CONSIDERATION BY THE COUNTY
COUNCIL, AN ADJUSTMENT IN THE RATES OF THAT UTILITY; to generally
address adjustments in rates when a utility is found to have
operated at a loss; and to submit this amendment to the qualified
voters of Anne Arundel County, Maryland for their adoption or
rejection. Approved August 16, 1982.
Bill No. 85-82 AN ORDINANCE pursuant to proposals of the Anne Arundel
County Charter Revision Commission concerning the establishment
of a Department of Utilities, to amend the Charter of Anne
Arundel County, Maryland by repealing and reenacting, with
amendments, Article V, "The Executive Branch", Section 507,
"Departments", Section 537, "Director of Public Works" and
Section 538, "Functions of the Department of Public Works"; by
repealing Article V, "The Executive Branch", Section 539, "The
Sanitary Commission"; by adding new Section 539, "Director of
Utilities" and new Section 539A, "Department of Utilities"; by
repealing and reenacting, with amendments, Article VI, "County
Board of Appeals", Section 602, "Powers and Functions of County
Board of Appeals", subsection (e), "Appeals from decisions on
