[(ii)] (III) Became licensed in the other
state after passing in that or any other state an examination
that: [is similar to the examination for which the applicant is
seeking the waiver;] 1. (III) AT THE TIME THE APPLICANT WAS
LICENSED IN THE OTHER STATE, WAS QUALIFIED TO TAKE THE
EXAMINATION THAT THEN WAS REQUIRED BY THE LAWS OF THIS STATE; AND 2. (IV) QUALIFIED FOR A LICENSE IN THE
OTHER STATE BY PASSING AN EXAMINATION GIVEN BY THE BOARD OF
OPTOMETRY IN THAT STATE. (3)  Presents a copy of the license, certified by the
issuing board; and (4)  Previously has not failed an examination given by
the Board. (C)  (1) THE BOARD MAY WAIVE THE EXAMINATION REQUIREMENTS OF
THIS SUBTITLE FOR AN APPLICANT WHO: (I)   IF SO REQUIRED BY THE BOARD UNDER
SUBSECTION (D) OF THIS SECTION, PASSES A CLINICAL AN EXAMINATION
ADMINISTERED BY THE BOARD; AND (II)   FOR 5 3 YEARS IMMEDIATELY BEFORE
APPLYING, HAS PRACTICED OPTOMETRY ACTIVELY. (2) THE BOARD MAY WAIVE THE REQUIREMENT OF PRACTICING
OPTOMETRY ACTIVELY FOR AN APPLICANT WHO FOR 3 YEARS: (I)  WAS TEACHING OPTOMETRY; (II)  WAS A MILITARY OPTOMETRIST; (III)  WAS A SUPERVISOR OR ADMINISTRATIVE
OPTOMETRIST; OR (IV)  WAS A RESEARCHER IN OPTOMETRY. (D)  (1) WITHIN 1 YEAR OF RECEIPT OF AN APPLICATION, THE
BOARD MAY REQUIRE THAT THE APPLICANT PASS A CLINICAL AN
EXAMINATION. (2) THE BOARD SHALL DETERMINE THE SCOPE, FORM, AND
PASSING SCORE FOR CLINICAL EXAMINATIONS UNDER THIS SECTION. [(c)] (E) The Board may grant a waiver only if the state
in which the applicant is licensed waives the examination of
licensees of this State to a similar extent as this State waives
the examination requirements for individuals licensed in that
state. ]
