AN ACT concerning
Optometric Examination - Waiver
FOR the purpose of altering the provisions of law under which an
optometric examination may be waived.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health Occupations
10-305.
(a) Subject to the provisions of this section, the Board
may waive the examination requirements of this title for an
individual who is licensed to practice optometry in any other
state.
(b) The Board may grant a waiver under this section only if
the applicant:
(1) Pays the application fee required by the Board
under § 10-303 of this subtitle;
(2) Provides adequate evidence that the applicant:
(i) Meets the qualifications otherwise required
by this title, INCLUDING, FOR 5 3 YEARS BEFORE APPLYING, THE
CONTINUING EDUCATION REQUIREMENTS THAT ARE EQUIVALENT TO THE
CONTINUING EDUCATION REQUIREMENTS OF THIS SUBTITLE THE OTHER
STATE IN WHICH THE APPLICANT HAS BEEN PRACTICING OPTOMETRY, OR,
IF THE OTHER STATE DOES NOT HAVE ANY CONTINUING EDUCATION
REQUIREMENT, THE APPLICANT SHALL MEET THE EQUIVALENT OF 3 YEARS
OF THE CONTINUING EDUCATION REQUIREMENTS OF THIS SUBTITLE IN
COURSES APPROVED BY THE BOARD; [and]
(II) MEETS THE TERMS AND CONDITIONS THAT THE
BOARD ESTABLISHES IN SUBSECTIONS (C) AND (D) OF THIS SECTION; AND
