license to set a gill net during any one year, or of any other
commercial net fishing license during any four consecutive years,
unless the failure to use the license is due to causes beyond the
control of the licensee and is approved by the Department, the
unused license lapses and may not be renewed. (b)] A license does not lapse if the licensee fails to
renew or make bona fide use of his license because of induction
or enlistment into the armed forces or employment in essential
war industries, and the licensee applies to the Department for
the renewal of his license within one year of the termination of
hostilities or from the date of his release from the armed
forces. If a licensee cannot fish every net for which he was
licensed at any time during a war emergency because of some
condition arising out of a war, he may not be deprived of his
right to a license for these nets thereafter. [(c) In November of each year, the Department shall mail
blanks to apply for renewal of license to each licensee at the
address given in his most recent application or to any other
address he designates in writing subsequent to filing an
application. The mailing constitutes sufficient notice and
warning that the license expires on December 31 of the same
year.] [4-707. In addition to any other penalty provided in this title, the
Department may revoke or suspend for a period of not less than
ten days, any license it issues pursuant to this subtitle after a
hearing is held upon not less than ten days prior notice to the
licensee. The following grounds are grounds for revocation or
suspension: (1)  Making any false statement in the application for
a net license; (2)  Conviction of the licensee or his agents of any
violation of the provisions of this subtitle; (3)  Violation of any Department rule or regulation; (4)  Failure to make the reports prescribed by law or
by the Department pursuant to law.] 4-709. A [resident of the State is entitled to receive] PERSON MAY
BE LICENSED TO UTILIZE a restricted gill net [permit] for
noncommercial fishing in the tidal waters of the Chesapeake Bay
and its tributaries, upon application and payment of a fee [of
$10]. [The permit shall be renewed annually upon payment of a
fee of $10.] The [permit holder] LICENSEE may fish a single
staked or anchored gill net, not to exceed 100 50 yards in
length and not to be used for commercial purposes. The use of
