nets fished under the provisions of this section is subject to
every law and every rule or regulation governing net fishing. The
Department may adopt rules and regulations governing use of gill
nets fished under the provisions of this section in any of the
waters of the State, restricting the use of gill nets in any
waters deemed necessary for conservation purposes, and regulating
the quantities of any species of fish caught by gill nets. [In
addition to any penalty provided by this title, the permit of any
person convicted of violating laws or rules and regulations
governing net fishing shall be revoked. Also, if a person is
convicted of violating the laws or rules and regulations
pertaining to illegal sale of fish, or use of nets fished, in any
prohibited area, he forfeits his right to receive a restricted
gill net permit for a period of five years. A permit holder
quarterly shall submit to the Department any required catch
records. Failure to submit catch records is cause for denying
renewal of the permit.]
4-710.
(b) [(1)] An appropriately licensed [resident of the State]
PERSON may fish in the waters of the Atlantic Ocean with an otter
trawl or beam trawl, subject to Department rules and regulations,
if the [resident] PERSON is at least one mile from the shoreline.
The Department rules and regulations shall include:
[(i) Establishing a license fee not exceeding
$50 annually for vessels employed in the fishery;]
[(ii)] (1) Setting seasons when otter trawl or
beam trawl fishing is permitted; AND
[(iii)] (2) Enumerating the species of fish
which may be taken[; and].
[(iv) Setting penalties, including suspension
or revocation of license, for violations of the Department's
rules and regulations adopted under the provisions of this
subsection.]
[(2) A nonresident who is the owner of a federally
licensed vessel may obtain a license to fish in the waters of the
Atlantic Ocean from that vessel, as provided in paragraph (1) of
this subsection, if the owner's state of residence provides
equivalent fishing rights and privileges to residents of this
State.]
4-736.
(a) The Department may supervise, regulate, and control
catching eels in the tidal waters of the State. In exercising
this power, the Department may prescribe the areas within and
methods by which eels may be caught.
