Subsection (b)(3) of this section combines former HE §
9-506(4) and (5), for clarity. Since former HE §
9-506(4) required the Department to consider certain
factors but did not state in what manner these factors
were to be considered, this subsection incorporates
certain provisions from former HE § 9-506(5), which
required the installation of community water supply,
sewerage, or solid waste disposal systems if the
systems were reasonably necessary giving due
consideration to the factors set forth in subsection
(b)(3) and (4) of this section. No change of
substance is intended.
Also in subsection (b)(3) of this section, the
reference to "individual water supply systems or
individual sewerage systems" is added to conform to
the overall scheme of administrative regulation and to
the administrative practice of the Department.
9-511. CONFORMANCE TO COUNTY PLANS REQUIRED -- IN GENERAL.
UNLESS THEY CONFORM TO THE COUNTY PLAN OR REVISION OR
AMENDMENT OF THE COUNTY PLAN, THE FOLLOWING SYSTEMS AND
FACILITIES MAY NOT BE INSTALLED OR EXTENDED:
(1) A WATER SUPPLY SYSTEM;
(2) A SEWERAGE SYSTEM;
(3) A SOLID WASTE DISPOSAL SYSTEM; AND
'(4) A SOLID WASTE ACCEPTANCE FACILITY.
REVISOR'S NOTE: This section is new language derived
without substantive change from the second and third
clauses of the first sentence of former HE § 9-511(b).
In item (1) of this section, the defined term "water
supply system" is substituted for the former
references to "community water supply ... system",
"multiuse water supply ... system", and "individual
water supply ... system".
In item (2) of this section, the defined term
"sewerage system" is substituted for the former
references to "community ... sewerage ... system",
"multiuse ... sewerage disposal system", and
"individual sewerage system".
9-512. SAME -- BUILDING PERMITS; SUBDIVISION PLATS.
(A) "BUILDING PERMIT" DEFINED.
IN THIS SECTION, "BUILDING PERMIT" MEANS ANY PERMIT THAT
ALLOWS ANY BUILDING CONSTRUCTION AND IS ISSUED BY ANY STATE OR
LOCAL AUTHORITY.
