(II) THE INDIVIDUAL SYSTEM IS CONSTRUCTED IN
THE MOST ECONOMICAL AND CONVENIENT WAY TO PERMIT CONNECTION TO A
COMMUNITY SYSTEM IN THE AREA, AND THE PERSON GUARANTEES THE
CONNECTION TO A COMMUNITY SYSTEM:
A. WHEN THE COUNTY GOVERNING BODY WHERE
THE AREA IS LOCATED SETS A TIME; AND
B. IN ACCORDANCE WITH THIS SUBTITLE, ANY
RULES AND REGULATIONS ADOPTED UNDER THIS SUBTITLE, AND ANY OTHER
STATE LAW OR COUNTY REQUIREMENT BY:
1. POSTING A BOND TO SECURE ACTUAL
CONSTRUCTION AND INSTALLATION OF THE SYSTEMS WITH SATISFACTORY
SURETY FOR THE BENEFIT OF THE COUNTY GOVERNING BODY; OR
2. MAKING ANY OTHER ARRANGEMENT
THAT THE DEPARTMENT CONSIDERS NECESSARY AND ADEQUATE TO CARRY OUT
THE PROVISIONS OF THIS SUBTITLE; AND
(7) IF A SOLID WASTE DISPOSAL SYSTEM IS NOT AVAILABLE
OR REQUIRED TO BE INSTALLED IN ANY AREA AS PROVIDED IN ITEM (4)
OF THIS SUBSECTION, TO ALLOW A PERSON TO PROVIDE A SOLID WASTE
ACCEPTANCE FACILITY IN THE AREA WITHOUT A SYSTEMATIC COLLECTION
AND TRANSPORTATION SYSTEM.
REVISOR'S NOTE: This section is new language derived
without substantive change from former HE §§ 9-506(1),
(3), (4), (5), (6), and (7), 9-508, and 9-510.
In subsection (a)(1) of this section, the former
references to "studies", "investigations", and
"analyses" are deleted as unnecessary in light of the
broader reference to "surveys and research".
Subsection (b)(1) of this section is substituted for
the former reference to the power of the Department to
" {s}tipulate any other matters that are necessary and
appropriate to the administration of this subtitle" in
light of the broad, general power of the Department to
adopt rules and regulations to carry out the
provisions of this subtitle.
Subsection (b)(2)(i) and (ii) of this section is
substituted for the former references to "individual
or community water supply or sewerage systems", to
conform to the apparent intent of former HE § 9-506(1)
and to the current practice of the Department also to
control, limit, or prohibit the installation and use
of multiuse water supply systems and multiuse sewerage
systems. See the definitions of "water supply system"
and "sewerage system" in § 9-501 of this subtitle.
