CHAPTER 542
(Senate Bill 674)
AN ACT concerning
Environmental Health - County Water and Sewerage Plans
FOR the purpose of revising, restating, clarifying, and
recodifying a subtitle of the Health - Environmental
Article, to be designated and known as "Subtitle 5. County
Water and Sewerage Plans", relating and pertaining to
certain environmental health matters, including matters
relating to community sewerage systems, community water
supply systems, county water and sewerage plans, individual
sewerage systems, individual water supply systems, litter,
lots, multiuse sewerage systems, multiuse water supply
systems, potable water, proposed county water and sewer
plans, sewage, sewerage systems, solid waste acceptance
facilities, solid waste disposal systems, subdivisions, and
water supply systems; revising and clarifying certain powers
and duties of the Department of Health and Mental Hygiene in
regulating county water and sewerage plans in this State;
revising and clarifying the laws relating to the authority
of and requirements for the governing bodies of the counties
in this State, including the county executives and county
councils of these counties, to propose, develop, adopt,
revise, amend, and use water and sewerage plans; revising
and clarifying the law relating to certain exceptions to the
requirements for county plans in Baltimore County, Carroll
County, Harford County, Montgomery County, and Prince
George's County; revising and clarifying certain powers and
duties of the Department to issue or approve certain permits
relating to the construction of water and sewerage systems
and to approve, disapprove or modify water and sewerage
plans, revisions, and amendments of certain counties in this
State; repealing and revising certain obsolete provisions
relating to county water and sewerage plans, including
approving authorities, sewerage systems, and water supply
systems; generally relating to matters concerning county
water and sewerage plans in the Health - Environmental
Article; changing a certain criminal fine to be a civil
penalty; defining certain terms; providing for the effect of
this Act on any change in nomenclature; providing for the
continuation and renewal of certain licenses, registrations,
permits, and certifications under this Act; and providing
for the effect, construction, and effective date of the
provisions of this Act.
