(House Bill 300)
AN ACT concerning
Oil Pollution Control - Duty to Report Discharge
FOR the purpose of requiring any person discharging or permitting
the discharge of oil to report the incident to the
Department of Natural Resources regardless of whether an
appropriate federal authority is also notified; requiring
the person to remain available until the Department gives
clearance to leave; and generally relating to notification
requirements concerning the discharge of oil.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
8-1410.
(b) Notwithstanding any provision of this subtitle, any
person discharging or permitting the discharge of oil, or who
either actively or passively participates in the discharge or
spilling of oil into the waters of the State either from a
land-based installation, including vehicles in transit, or from
any vessel, ship, or boat of any kind, shall report the incident
immediately to the [appropriate federal authority or the]
Department of Natural Resources[, or both]. He shall remain
available until clearance to leave is given by the [ appropriate
officials DEPARTMENT DESIGNATED BY THE DEPARTMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
