RULE OR REGULATION ADOPTED UNDER IT IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $25.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 243 and all but the last clause of § 229.

Subsection (a) of this section is revised to
clarify that the prohibition applies to the
person who makes common cups and towels available
for use, rather than the user.

In subsection (b) of this section, the defined
term "Secretary" is substituted for the
references to the former "State Board of Health".

Also in subsection (b) of this section, the
former references to rules and regulations "as in
their judgment {may seem} wise and proper" are
deleted as unnecessary in light of the word
"may".

The last clause of former Article 43, § 229,
which granted a right of appeal to the Public
Service Commission, is deleted as inconsistent
with a criminal conviction.

18-504. VIOLATIONS OF RULES AND REGULATIONS.

A PERSON WHO VIOLATES ANY RULE OR REGULATION THAT THE
SECRETARY ADOPTS UNDER § 18-102 OF THIS TITLE IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $500.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second clause
of the first sentence of former Article 43, § 31.

Defined term: "Person" § 1-101

GENERAL REVISOR'S NOTE:

Throughout this title, the term "health officer", as
defined in § 1-101 of this article, is used. Some of the
former provisions now revised in this title expressly stated
that a reference to a "health officer" included the
Baltimore City Commissioner of Health, but other former
provisions contained only ambiguous references to a "health
officer", "health authority", or "health commissioner".
However, the Baltimore City Commissioner of Health and the
Department concur that all of the provisions of this title
