HARRY HUGHES, Governor

873

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 58.

In the introductory clause of subsection (a) of
this section, the reference to an "infectious
disease that endangers public health" is
substituted for the reference to a "dangerous
infectious disorder", to conform to other
references in this title and to Department
practice.

In subsection (a)(1) of this section, the former
enumeration of types of public places is deleted
as unnecessary.

Also in subsection (a)(1) of this section, the
former specific requirement for notice to the
owner, conductor, or driver' of a public
conveyance is deleted as unnecessary in light of
the broad reference to "proper precautions" and
as unenforceable.

In subsection (a)(2) of this section, the word
"transfer" is substituted for the phrase "gives,
lends, sells, transmits or exposes", for clarity
and brevity.

Also in subsection (a)(2) of this section, the
former enumeration of articles that are exposed
to infection is deleted as unnecessary.

In subsection (b) of this section, language is
added to state that a violation is a
"misdemeanor".

Also in subsection (b) of this section, the
former reference to the circuit court and the
Criminal Court of Baltimore is deleted as
unnecessary and inconsistent with the
jurisdiction of the district courts.

Defined term: "Person" § 1-101

18-502. SAME -- BY OTHER PERSON.

(A) PROHIBITED ACTS.

A PERSON MAY NOT:

(1) WILLFULLY OR KNOWINGLY TAKE AN INDIVIDUAL
WHO HAS AN INFECTIOUS DISEASE THAT ENDANGERS PUBLIC HEALTH
