18-403. RELIGIOUS EXCEPTION.

UNLESS THE SECRETARY DECLARES AN EMERGENCY OR DISEASE
EPIDEMIC, AN INDIVIDUAL MAY NOT BE REQUIRED TO BE IMMUNIZED,
IF THE INDIVIDUAL OBJECTS, IN WRITING, TO IMMUNIZATION
BECAUSE IMMUNIZATION IS AGAINST THE RELIGIOUS BELIEFS AND
PRACTICES OF A RECOGNIZED CHURCH OR RELIGIOUS DENOMINATION
TO WHICH THE INDIVIDUAL BELONGS.

REVISOR'S NOTE; This section is new language derived
without substantive change from former Article
43, § 81A(b).

The former reference to "vaccination" is deleted
as unnecessary in light of the broad reference to
"immunization".

Former Article 43, § 81A(a), which required the
adoption of rules and regulations on smallpox
immunization, is deleted as obsolete.

SUBTITLE 5. PROHIBITED ACTS; PENALTIES.

18-501. EXPOSURE OF OTHER INDIVIDUALS — BY INFECTED
INDIVIDUAL.

(A)  PROHIBITED ACT.

AN INDIVIDUAL WHO HAS AN INFECTIOUS DISEASE THAT
ENDANGERS PUBLIC HEALTH MAY NOT WILLFULLY:

(1)  BE IN A PUBLIC PLACE WITHOUT TAKING PROPER
PRECAUTIONS AGAINST EXPOSING OTHER INDIVIDUALS TO THE
DISEASE; OR

(2)  TRANSFER TO ANOTHER INDIVIDUAL ANY ARTICLE
THAT HAS BEEN EXPOSED TO THE DISEASE WITHOUT THOROUGHLY
DISINFECTING THE ARTICLE.

(B)  PENALTY.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SECTION IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $500 OR IMPRISONMENT NOT EXCEEDING 1 YEAR
OR BOTH.
