HARRY HUGHES, Governor
717
this article.
In subsections (a) and (b) of this section, the
defined term "county" is substituted for the
words "local" and "political subdivision", for
conformity to § 13-410 of this subtitle and for
clarity, since the words "local" and "political
subdivision" inappropriately suggest towns,
cities, and districts.
In subsection (d) of this section, the word
"compensation" is substituted for "pay", to
conform to similar provisions elsewhere in this
article.
The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that the Governor appoints the members to the
county commissions for indefinite terms. Thus,
the members serve until resignation, death, or
removal for failure to attend meetings as stated
in Article 41, § 4 of the Code.
Defined terms: "County" § 1-101
"County commission" § 13-401
"Secretary" § 1-101
13-412. GIFTS, GRANTS, OR AID.
IF THE FEDERAL GOVERNMENT, ANY OF ITS AGENCIES OR
OFFICERS, OR ANY OTHER PERSON OFFERS TO THIS STATE OR TO ANY
COUNTY ANY SERVICES, EQUIPMENT, SUPPLIES, MATERIALS, OR
FUNDS BY WAY OF GIFT OR GRANT FOR PURPOSES OF PHYSICAL
FITNESS, THIS STATE, ACTING IN ACCORDANCE WITH THE
REQUIREMENTS OF LAW, MAY:
(1) ACCEPT THE OFFER; AND
(2) AUTHORIZE ANY OFFICER OF THIS STATE OR OF A
COUNTY TO RECEIVE AND USE THE AID AND ASSISTANCE.
REVISOR'S NOTE: This section formerly appeared as
Article 41, § 344(b).
The defined term "county" is substituted for the
phrase "any such political subdivision", which
apparently referred to the reference to "county"
in former Article 41, § 344(a). See also
revisor's note to § 13-411 of this subtitle.
The second sentence of former Article 41, §
344(b) is incorporated into this section by use
of the defined term "person". Arguably, there
are some slight substantive differences between
the first and second sentences in former Article
