It is set forth as a separate section for
emphasis.

The word "State" is added to distinguish between
the State Commission and the county commissions
and to achieve uniformity among the names of the
entities that this article governs.

Defined term: "Department" § 1-101

13-404. STATE COMMISSION -- MEMBERSHIP.

(A) COMPOSITION; APPOINTMENT OF MEMBERS.

THE STATE COMMISSION CONSISTS OF 25 MEMBERS APPOINTED
BY THE GOVERNOR WITH THE ADVICE OF THE SECRETARY.

(B). QUALIFICATIONS.

EACH MEMBER SHALL BE AN INDIVIDUAL WHO HAS EXPERIENCE
OR INTEREST IN PHYSICAL FITNESS FOR BOTH CHILDREN AND
ADULTS.

(C) TENURE; VACANCIES.

(1)  THE TERM OF A MEMBER IS 4 YEARS.

(2)  THE TERMS OF MEMBERS ARE STAGGERED AS
REQUIRED BY THE TERMS PROVIDED FOR MEMBERS OF THE STATE
COMMISSION ON JULY 1, 1982. THE TERMS OF THOSE MEMBERS END
AS FOLLOWS:

(I)  7 IN 1983;

(II)   6 IN 1984;

(III)   6 IN 1985; AND

(IV)   6 IN 1986.

(3)  AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

REVISOR'S NOTE: Subsections (a) and (b) of this section
are new language derived without substantive
change from the first sentence, except for the
reference in that sentence to the chairman, and
the entire second sentence of former Article 41,
§ 340(a).
