LAWS OF MARYLAND

Ch. 21

THE APPLICATION SHALL PROVIDE THE INFORMATION THAT THE
SECRETARY REQUIRES.

REVISOR'S NOTE: This section formerly appeared as
Article 59, § 33(c).

In subsection (b) of this section, the former
phrase "from time to time" is deleted as
unnecessary.

The only other changes are in style.

Defined terms: "License" § 10-501
"Secretary" § 1-101

10-506. INVESTIGATION OF APPLICANT.

WHEN AN APPLICATION FOR A LICENSE IS FILED, THE
DEPARTMENT PROMPTLY SHALL INVESTIGATE THE APPLICANT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of former Article 59, § 33(d).

Although former Article 59, § 3(d) defined
"Department" to mean the Administration, the
reference to "Department", as the Department of
Health and Mental Hygiene, is retained to reflect
the apparent intent of Ch. 435, Acts of 1981,
which specified another unit in the Department as
the licensing entity. See revisor's note to §
10-503 of this subtitle.

Defined terms: "Department" § 1-101
"License" § 10-501

10-507. ISSUANCE OF LICENSE.

THE DEPARTMENT SHALL ISSUE A LICENSE TO ANY APPLICANT
WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 35(a), as that subsection related to denial
of licenses, and the second sentence of § 33(d).

Although former Article 59, § 33(d) provided for
the issuance of a license to an applicant who
meets the "requirements of its rules and
regulations", this section is revised to cover
additional statutory requirements of this
subtitle, in accordance with the apparent intent
of former Article 59, § 35(a), which referred to
a failure "to comply with ... applicable laws of
the State."
