addition to holding any other license required by
law," is added to state expressly that licensing
under this subtitle does not preclude meeting
other applicable licensing requirements; see §
10-104 of this title.

The phrase "operate a private, inpatient
facility" is substituted for the reference to
"admit, receive or detain any patients having any
mental disorder for the purpose of care or
treatment of such disorder", to reflect that, in
practice, the Administration uses "admit",
"receive", and "detain" only in connection with
"inpatient" care and treatment and, thus,
licenses only inpatient facilities under this
provision. Separate authority for licensing
private group homes appears in Part II of this
subtitle. However, there are other private
facilities that are neither inpatient nor group
homes and for which there are no licensing
provisions.

The former reference to the "Division of
Licensing and Certification" is deleted to avoid
reference to a nonstatutory unit, since the
Secretary may transfer its functions at will.
