PART I. GENERAL PROVISIONS FOR FACILITIES.

10-501. "LICENSE" DEFINED.

IN PART I OF THIS SUBTITLE, "LICENSE" MEANS A LICENSE
ISSUED BY THE DEPARTMENT TO OPERATE A PRIVATE, INPATIENT
FACILITY.

REVISOR'S NOTE: This section is new language added to
allow concise reference to a license issued under
Part I of this subtitle.

10-502. RULES AND REGULATIONS.

(A)   IN GENERAL.

THE SECRETARY SHALL ADOPT RULES AND REGULATIONS FOR
LICENSING PRIVATE, INPATIENT FACILITIES.

(B)  CONTENTS.

THE RULES AND REGULATIONS SHALL ENSURE THAT CARE AND
TREATMENT OF INDIVIDUALS WHO HAVE A MENTAL DISORDER ARE
PROVIDED IN ACCORDANCE WITH THE POLICY STATED IN SUBTITLE 1
OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 33(b).

As to the reference to "private, inpatient
facilities" in subsection (a) of this section,
see revisor's note to § 10-503 of this subtitle.

10-503. LICENSE REQUIRED.

IN ADDITION TO HOLDING ANY OTHER LICENSE REQUIRED BY
LAW, A PERSON SHALL BE LICENSED BY THE DEPARTMENT BEFORE THE
PERSON MAY OPERATE A PRIVATE, INPATIENT FACILITY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 33(a) and rephrased in the standard
language used to state affirmatively that a
person must be licensed to operate a private
facility. See also § 10-1001 of this title.
